HARRIS (Petitioners), and file this their Petition to Vacate the Plat of Lost Spring Estates Unit I Subdivision filed in the Kerr County Plat Records on November 20, 1986, and recorded at Volume 5, Page 282, of the Kerr County Plat Records and in support thereof would respectfully show this Court the following: I Petitioners own all of the eleven (11) lots in the Lost Spring Estates Unit I Subdivision. Petitioners acquired the Lost Spring Estates Unit I Subdivision by purchase of the entire Subdivision from E. J. Toudouze, Jr. on October 6, 1994. Petitioner's deed to the Lost Spring Estates Unit I is recorded in Volume 0768, Page 240 of the Official Public Records of Kerr County, Texas, a true and correct copy of which such deed is attached hereto as Exhibit "A" and is incorporated herein by reference, word for word, verbatim. Petitioners own an unplatted 178.094 acre tract contiguous to the Lost Spring Estates Unit I Subdivision. II Petitioners seek to cancel all of the Subdivision including any dedicated easement or roadway and seek to re-establish the property as an acreage tract as it existed before the Lost Spring Estates Unit I Subdivision. The cancellation of all of the Subdivision does not interfere with the established rights of any purchaser for the reason that Petitioners own all of the Subdivision and agree to the cancellation. III Petitioners pray for an order of this Commissioner' s Court authorizing them as owners of the Lost Spring Estates Unit I Subdivision to file an instrument canceling the Lost Spring Estates Unit I Subdivision.
