Commissioner Holekamp, seconded by Commissioner Oehler, the
Coisr-t unanimously approved by a vote of 5-0-0, the agreement
between the City of terrville and Ker•r• County regarding
f~_mding of City of Kerrville recycling center and to pay

THIS INTERLOCAL RGREEMENT is made and entered into on this
the 12 day of November, 1996, by and between the City of
Kerrville, Texas, ("City"), and the County of Kerr, Texas,
("Co~_tnt y")
WITNESSETN:
WHEREAS, the City awns and operates ca solid waste recycling
center at 50@ Hays Street ("the Center");and
WHEREAS, the Center is r.~seci by anti benefits residents of I:err
County who do not live within the incorporated limits of the
City of Ker•r•ville by per•initting non-City r•esident~a to recycle
certain solid waste items instead of inc~_rrr-ing the cost of
dispor>ing such items ta't the City of Kerrville landfill at
their personal expense; and
WHEREAS, the City desires to extend the operating hours of the
Center and hired additional personnel to staff the Center
d~_iring s~_rch extended hours;and
WHEREAS, recognizing the benefit to received by the extension
of the Center-~'s operating hours to non-City residents of the
Co~_rnty, Co~_mty has agreed to provide f~_md=. to assist in the
operation of the Center;
NOW, THEREFORE, in consideration of the recitals set forth
above and the convenants expressed herein, and in accordance
with the Interlocal. Caoper•ation Act ("fex. Govt. Code
ss7911.001, et. seq. ), City and Co~.inty hereby agree as follows:
1. County agrees to pay to City, not later than December
1, 1996, the amount of X5,000.00.
c. City agrees as follows:
a. The funds to be provided by Co~_uity p,_irsuant to Paragraph
1, above, will be rased solely 'for the operation of the
Center and for no other p,_rr•pose;
b. City will hire an additional part-time employee to staff
the Center;
c. On or before December ]., 1996, the City will extend the
m_imber- of ho,_irs of operation in which the Center is
open to the pi_~bJ.ic far drop-off of recyclable solid
waste from twenty--seven (27) to thirty-six (36>.
d. City at all times shall be solely responsible for the
oiler^ation of the Center and all liahilities related
thereto, it being understood and agreed by City that
County's responsibility under- this Agreement is simply
to pr~avide the above described f,_inds in exchange for
City's agreement to expand the operations of the Center
in a rtianner that benefits non-City residents of the
Co~_mty.
3. County agrees that the benefits received by the Co~_mty for
the City's extended operation of the Center and malting the
Center available to rron--City residents of County is a
reasonable and fair exchange of val~_re for the fi_urds
provided to City p~_rrs,_iant to Paragraph 1, above.
A. This contract has been made in and shall be construed in
accordance with the laws of the State of Texas. Venue shall
be in I;er-r Co~_mty, Texans.

("the Center"), and
WHEREAS, the Center is used by and benefits residents of Kerr County who do not live
within the incorporated limits of the City of Kerrville by permitting non-City residents to recycle
certain solid waste items instead of incurring the cost of disposing such items at the City of Kerrville
landfill at their personal expense, and
WHEREAS, City desires to extend the operating hours of the Center and to hire additional
personnel to staff the Center during such extended hours; and
WHEREAS, recognizing the benefit to be received by the extension of the Center's operating
hours to non-City residents of the County, County has agreed to provide funds to assist in the
operation of the Center;
NOW, THEREFORE, in consideration of the recitals set forth above and the covenants
expressed herein, and in accordance with the Interlocal Cooperation Act (Tex. Govt. Code
§§791 001, et.seq.), City and County hereby agree as follows:
