Denson Kerr County Judge Kerr County Courthouse Kerrville, Texas 78028 RE: Administration/Operation of Kerr County OSSF Program Interim Basis, Through September 30, 1996 Memorandum of Understanding Dear Judge Denson and Members of the Court: Whereas the Kerr County Environmental Health Department is without an administrator and sufficient staff to administer the program in an efficient and effective manner; and Whereas, Kerr County and the Upper Guadalupe River Authority are developing an Interlocal Cooperation Agreement which will provide for the administration and operation of the Kerr County OSSF and other Kerr County Environmental Health Department programs beginning on October 1, 1996; and Whereas, the Upper Guadalupe River Authority is willing to assume the administration and operation of the OSSF and related programs on an interim basis until October 1, 1996, but on terms more suitable to an interim basis; UGRA proposes the following: That UGRA will assume the responsibility for administering and operating the Kerr County OSSF and related programs upon the execution of this Memorandum of Understanding and will assume that responsibility through the end of the business day ending September 30, 1996. 2. That UGRA will make available to the County on an interim basis, one or more Registered Sanitarians, Water Quality Specialists and other necessary UGRA employees to deliver the services required by the OSSF Program (Water Quality Specialists), in which the County agrees to pay UGRA an amount of $1,000.00 per month through September 30, 1996. 3. That UGRA will provide accounting and reporting services to the County on the interim basis through September 30, 1996. P.O. That UGRA will collect all fees and make daily deposits in accordance with the instructions from the County and that UGRA will provide the County with a monthly report indicating program activity and revenues collected relative to the program. 5. That the County will reimburse the UGRA for the rent, utilities and telephone expenses for an additional office space adjacent to the UGRA offices at 215 West Water Street. 6. That the County will employ the services of a professional, if necessary, to assist with the revisions of the Kerr County OSSF Rules and Regulations to comply with the TNRCC Amended Rules published in the July Teams Register, and that the County will with all diligence, work and schedule the Rules and Regulations revisions for adoption on or before September 30, 1996. 7. That the County will make available to the UGRA, by loan, assignment or other acceptable means, the necessary furniture, fixtures and equipment required to administer/operate the Ken County OSSF Program which include but are not limited to: a. 1989 F-150 Ford Pickup b. Filing cabinets with all records intact c. Flood plain maps and reviewing table (light table) d. Secretary and executive desks; desk and side chairs e. Computer hazdwaze and softwaze applicable to the programs being transferred to UGRA and printers (ink jet and dot matrix) f. Field equipment currently used by the County employees assigned to the program. g. The current telephone number - 210/896-5101 h. Computer desk and accessories i. Hand levels and miscellaneous measuring instruments, transit and tripod and various rods j. Bookcases -One at 3-shelf; Two at 2-shelves k. Side chairs - 7 (2 Brown and 5 gold) 1. Blueprint holders (2) m. Health Code (books) manuals, maps and brochures relating to the OSSF program. n. Available desk accessories, staplers, calculators, tape dispensers and other miscellaneous desk equipment. p. Office supply inventory including but not limited to: file folders, pens, pencils and other consumable office supplies 8. That UGRA will inventory and sign for the equipment and shall maintain same in working condition until such time the UGRA returns the inventory to the County which will be as soon thereafter as reasonably possible subsequent to the entry into the Interlocal Agreement and the collection of funds from the Agreement or the County elects to otherwise dispose of the same. 9. That the County will continue the employment of the current field inspector (Mr. Bowers), and that the County will pay from its funds, the salary and benefits of the above-mentioned position for the duration of this interim agreement. 10. That the County will relocate or cause to be relocated, all of the furniture, fixtures and equipment above-mentioned to the UGRA offices at 215 West Water Street within five (5) working days from execution of the agreement or as soon therafter as reasonably possible. 11. The County and UGRA mutually agree that the terms of this agreement can be extended or amended in order to assure the citizens of Kerr County an uninterrupted OSSF Program until such time the permanent Interlocal Cooperation Agreement is executed and becomes effective. 12. The County and UGRA mutually agree that in case of any one or more of the provisions contained in this Memorandum of Understanding shall for any reason be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision hereof and this Memorandum of Understanding shall be construed as if such invalid, illegal or unenforceable provision has never been contained herein.
