Annually, we allocate excess margins from the previous operating year to each member who provided patronage capital during that year. These allocations are refunded when the cooperative meets certain criteria and is finanaally stable. There aze 75 electric distribution coeperatives operating in Texas and each has their individual procedure for refunding capital credits. When an electric cooperative refunds capital credits and they remain unclaimed after three years they are sent to the Texas State Treasurer. In 1993 the Texas Legislature passed a law allowing individual counties to request a portion of the unclaimed_ ital credits escheated b electric coeperatives to promote economic development in their communities. The new law too t e fect in 1995 and can be found in Section 74.602 (b)(3) of the Texas Property Code. Beginning in 1995, any capital credits escheated by electric cooperatives to the State are required to have a county code associated with each missing owner. This will allow the State Treasurer's office to access the capital credit total for each county. Each county must request the funds from the State Treasurer and last month a letter was mailed to each CommissioneYs Court explaining the procedure for claiming the funds. Vander Zee, General Manager February 20, 1998 County Commissioners Court County Courthouse Street City Dear Commissioners: Effective September 1, 1995, Section 74.602{b)(3! of the Texas Property Code allocates a portion of the unclaimed money fund " ... to each county of the state that requests. an amount equal to any capital credits in the~fund, less anticipated claims. that were delivered under this chapter to the state treasurer by an electric cooperative corporation on behalf of the corporation's members in that county, with the money to be used only to carry out a program under Section 381.004, Local Government Code ... Based on years of data and experience, the amount available to each county will be based on total remittances received from that county, less a minimum of 30% for anticipated claims. Because service areas of electric cooperatives frequently cross county boundaries, a collaborative effort is necessary ~, at the reporting stags. We've written to the electric cooperatives, outlining instructions on how and what is required in their reports to allow us to comply with your requests. Because the Commissioners' Court is the primary governing body and ultimate decision-making authority regarding the legitimacy of requests for tunds under this new provision, the procedures for making such requests are as foibws: 1) Requests are to be submitted, in writing, to the Texas Treasury ONLY duriing the montfis of June and July of each year, beginning in 1996, for capital credits received on unclaimed property reports in the preceding November 1 reporting period. 2! Alf written requests and grants of authorization to deliver funds to your designated representative, if any, will be addressed directly to the Treasury by the Commissioners' Court. 3) The requests shall include the complete name, address, and social security number or federal tax identification number of the party to which the funds are to be paid. 4) The Treasury will mail the payment (a state warrant! to the naquesting Commissioners' Court for distribution. IMPORTANT: All requests must include certification that the purpose of the requested transfer of funds is in compliance with the provisions of Section 381.004 of the Texas Local Government Code.
