Denson Frem: David Motley Date: February 7, 1996 Subject: Forensic Engineering Services Judge Denson: I have had an opportunity to educate myself somewhat concerning construction and foundations and I strongly feel that prior to the county fmally accepting the new law enforcement facility, we should retain the services of an independent engineer (specifically an engineering speciality known as forensic engineering) to complete some core sample analyses of the foundation/slab in various locations throughout the jail, for the purpose of determining the extent of the several cracks in azeas we did observe. Appazently there aze more cracks in locations other than what was displayed on the tour this past Monday. There aze numerous other engineering firms in San Antonio who are in no way associated with this project who could do a competent evaluation. There has been little rainfall during the project's construction and a significant rain could cause any structural defects to become more readily appazent to the layman's eye. Although I am not representing the court in all civil matters, I do feel that our leverage would decline following final acceptance and should the analyses reveal problems, I would imagine that either the contractor, sub-contractor, architect or various sureties would be in a position to remit such fees. In short, I am not comfortable assuming that the cracks are minor and will not worsen, without further independent investigation. In that vein, I would certainly like for "our" group of citizen engineers to have the foundafion samples, soil core samples and plasticity studies made available to that group and along those lines, I have enclosed a copy of a January 22, 1996 "Petition" given to me by persons identified as "Concerned Citizens of Ken County." However worded, I think the safe wurse of action for the court to take would be to construe this petition as a request under the Texas Open Records Act and respond accordingly.
