Dear Judge Denson:
I appreciate the opportunity to provide structural engineering investigation services to determine if the
cracks in the concrete topping slab cause a structural problem with the building.
Fee for services shall be based on our current hourly rates but should not exceed $5,000. Hourly rates
currently in effect are:
Services performed	by a registered engineer:	$95	per hour.
Services performed	by a graduate engineer:	$40	per hour.
Services performed	by technicians:	$40	per hour.
Services performed	by secretarial staff:	$20	per hour.
Expenses shall be reimbursed plus 15 percent. Payment for services shall be made monthly based on the
percent of the services performed. Fee during litigation, if necessary, shall be plus 50 percent. Payment for
services shall be made monthly based on the percent of the services performed.
Kerr County and Beicker Engineering, Inc. have considered the risks, rewards, and benefits of the project when establishing the Engineer's
total fee for services. The risks have been allocated such that Kerr County agrees that to [he fullest extent permitted by law Beicker
Engineering, Inc.'s totally liability [o Kerr County for any and all injuries, claims, losses, expenses, damages or claims expenses arising out
of [his Agreement from any cause or causes, shall no[ exceed the total amount of fee paid [o Beicker Engineering, Inc. or $50,000,
whichever is smaller. Such causes include, but are not limited to Beicker Engineering, Inc.'s negligence, errors, omissions, strict liability
or breach of contract.
