RE: Inter\Permaglas Warranty Validation Procedures
Enclosed please find the Inter\Permaglas warranty form. The
warranty is a four (4) part document, you only get three (3), the
fourth part is kept in our files. This document will require the
validation of not only Inter\Permaglas' authorized
representative, but also the contractor and the owner. 'Phis
procedure provides verification to both Inter\Permaglas and the
contractor that the owner is aware of the terms and conditions of
the warranty. The execution by the owner also brings us in
compliance with various provisions in the Uniform Commercial Code
which has been adopted by most states.
This warranty is not binding upon Inter\Permaglas until such time
as same has been properly executed by not only Inter\Permaglas,
but also the contractor and the owner, with a fully executed copy
of same returned to the Technical Services Department, Attn:
Sandra Martin. AFTER OBTAINING ALL SIGNATURES, RETURN ONLY THE
INTEC/PERMAGLAS COPY. Notice of the forwarding of this warranty
will also be provided by copy of the warranty to the local
Inter\Permaglas Sales Representative.
In order for the warranty to be fully executed and valid, it must
be signed by all parties and Inter/Permaglas' copy returned
within sixty (60) days.
In the event you have any questions or concerns regarding the
procedures detailed hereinabove or those incorporated in the
warranty, please do not hesitate to contact the Technical
Services Department at 1-800-624-6832 Ext. 25 to discuss same.
It remains the opinion of Inter\Permaglas that the warranty
issued by the company upon its roofing membranes has been, and
continues to be, the most comprehensive in the industry. I am
sure you and your customers will agree.

With regards to the warranty issuggi for the abovie referenced
project, we would make the following comments.
The date that the warranty goes in#o effect is the date of
completion. The date areas on the bottom of the'Iwarranty next to
the signatures is to be dated when sigue~i by the,coutractor and
the owner. These dates have nothiZtig to da with !the completion
date or date that the warranty goes inta effect.,

Intec/Permaglas ("Permaglas'") warrants that the components of the Roofing System as defined hereinbelow will be free from (i)
manufacturing defects, (ii) deterioration as a result of ordinary wear and tear from exposure to the elements, (iii) splits, fissures or tears
not caused by structural or roof deck movement or failure, or (iv) application /installation defects for the warranty period specifically
delineated herein and subject to the maximum dollar limit set forth hereinbelow. It said defects cause the Roofing System to fail to perform
to customary industry tolerances, then subject to said dollar limitation, Permaglas shall be obligated to, at its sole discretion, repair and/
or replace that portion of the warranted components of the Roofing System which may have failed at Permaglas' sole cost and expense.
This warranty is limited to the original purchaser ("Owner") and is expressly not transferable unless transfer has been approved pursuant
to the terms and conditions set forth hereinbelow. THIS WARRANTY IS EXPRESSLY IN LIEU OF ANY AND ALL OTHER
WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR
A PARTICULAR PURPOSE. THE TERMS AND CONDITIONS OF THIS WARRANTY SHALL BE THE SOLE AND EXCLUSIVE
REMEDIES OF THE OWNER, AND THE OWNER SHALL BE ENTITLED TO NO FURTHER OR ADDITIONAL REMEDIES. THE
OWNER HEREBY EXPRESSLY WAIVES ANY AND ALL OTHER CLAIMS FOR DAMAGES, WHETHER DIRECTOR INDIRECT,
CONSEQUENTIAL OR INCIDENTAL, INCLUDING PROPERTY DAMAGES, PERSONAL INJURY DAMAGE TO THE OWNER OR
THIRD PARTIES AND/OR LOSS OF BUSINESS OR PROFITS. Permaglas shall have no obligation under this warranty, and this
warranty shall be of no force and effect unless and until this warranty is validated as required hereinbelow. Unless Permaglas, the owner
and the roofing contractor have validated this warranty, the components of the Roofing System manufactured by Permaglas are sold AS
IS with no warranties, express or implied. Additionally, this warranty shall be of no force and effect unless subsequent to validation of
this warranty by Permaglas, the terms and conditions of this warranty are acknowledged and accepted by the owner and the contractor,
whose acknowledgment and acceptance are evidenced by their signatures hereinbelow, with a copy of said acknowledgment timely
returned to Permaglas.

must be forwarded to Permaglas within thirty (30) days of receipt of the warranty after validation by Permaglas. Once this warranty has been
validated by Permaglas, if delays in the approval and execution of same by both the owner and the contractor are encountered which will prevent
