The County Judge of Kerr County, Texas is authorized to issue a letter in favor of the City of Kerrville stating the following: a. That Kerr County has received a letter of credit for payment of all costs and expenses for acquisition of land required to be paid by Saddlewood Partners I, Ltd. pursuant to the terms and conditions of the contract for acquisition of land between Dominion Land and Cattle Co., Inc., Lewis Brazelton, Trustee, and Kerr County for the Thompson Drive/Spur 98/High Water Bridge Project. b. That Kerr County, Texas has received a letter of credit from Saddlewood Partners I, Ltd. for construction of a roadway to county specifications in accordance with the terms and conditions of the contract for acquisition of land between Dominion Land and Cattle Co., Inc., Lewis Brazelton, Trustee, and Kerr County. c. That Kerr County has received a letter of credit from Saddlewood Partners I, Ltd. for construction of private roadways in Section One of Saddlewood Estates. d. That Kerr County has received a temporary three (3) year easement for construction of roadways in Section One of Saddlewood Estates. e. That Kerr County is proceeding immediately to acquire the land identified in the contract for acquisition of land. f. That upon acquisition of the land Kerr County will see that a public roadway meeting county specifications is constructed in accordance with the contract for acquisition of land. g. That Kerr County has received a letter of credit 1 SADDLE\CC5.SAD\032196 for the construction of private roadways in Saddlewood Estates, Section One and a three (3) year easement for construction of those roadways and that Kerr County will see that those private roads are constructed. 2. Issuance of the letter authorized by this order is contingent upon: a. Receiving the letter of credit for cost and expenses regarding acquisition of the land under the terms and conditions of the contract for acquisition of land. b. Receipt of the letter of credit for construction of a public roadway to county specifications on that portion of the land identified in the contract for acquisition of land. c. Receipt of 'the letter of credit for construction of private roadways of Section One of Saddlewood Estates. d. Receipt of the temporary easement for construction of private roadways in Section One of Saddlewood Estates. 3. Thomas Pollard is hereby retained and employed to represent Kerr County in this matter. 4. The Kerr County Judge, attorney representing Kerr County, all elected Kerr County officials and employees, acting at the direction of the Kerr County Judge, are fully authorized to carry out and consummate any and all actions the Kerr County Judge may deem necessary and proper to carry out the intent and purpos/e of thist~order., This order was adopted on l ~ U ~T-f , 1996. ~ ~'~L--, RO RT A.
