Kerrville, TX 78028 ,... {8301 257-2993 FAX (830) 896 8481 TO: Commissioners' Court FROM: Leonard Odom, Jr., Road Administrator DATE: October 27, 1997 RE: Repair Of Right-Of--Ways Damage Done By Water Companies Tn the pas[ few weeks we have had numerous complaints about water wmpanies doing repair work in County right-of--ways and leaving the right-of--way in bad condition. 1) Charlie Wiedenfeld crossed the road and driveways on Chole Lane in Precinct 4. After the job was complete there was a mud problem. When we talked to him on the phone, he said he felt that it was in goad shape. Both Franklin and I looked at the job and informed him by phone that it needed to be cleaned up. He did nothing. Franklin wrote him the attached letter and our office told the homeowners they should contact him to repair the damages. After re°eated calls, his secretary asked us to repair the damages and bill the water company because Wiedenfeld had left town without fixing the problem and she didn't know what else to do. 2) Mr. Bruce Coffer called our office to report that Kerrville South Water had moved large boulders that were being used as a barrier to keep cars from going over the side on Southway when they installed a water line in the right-of--way. Mr. Coffer feels Kerrville South Water should be responsible for the cost of replacing the rocks or putting up a guardrail. We explained that we had no pohcing powers and no provisions for billing. 3) Right after we finished surfacing Ranchero Road and clearing the rightof--way, Hill Country Utilities wanted to cross the road with a water line. We told them they would have to bore. They bored October 3, 1997. After two calls, to this date they have not cleaned up the mess left on the right-of--way. All ofthe utility companies have been asked to notify us before they cross a County maintained road by sending a written explanation with an attach drawing that is filed by road name for future reference. This helps us to be aware they are working in the area and better respond to the citizens. It also gives us a chance to evaluate the road surface to see if they need to bore or if they can cut the road surface. After they have met the specifications for cutting and back-filling we will then patch the surface and inspect the job to see that it is completed satisfactorily. We have no problems with any of the telephone or electric companies. We ask that you consider ways to make these companies accourrtable. If we can charge them for repairs and put the money into our current budget it might help? Do we need to add something to the new subdivision rules? If so, who would be responsible for enforcement?
