Denson From: David Motley Date: October 9, 1997 Subject: Resurfacing of Clearwater Paseo Judge: Enclosed please find a request from the city for maintenance of Clearwater Paseo in conformity with the attached agreement signed by Commissioner Holekamp in 1995. It is my opinion that to give Mr. Holekamp's agreement the validity it requires, you should place this item on the agenda for ratification. Glenn was the commissioner with oversight responsibility for the construction of the justice center and that designation may carry with it a certain level of apparent authority. He certainly would not have entered such an agreement without the consent of the court as a whole. I am told that the construction methods of Clearwater Paseo raised questions for the city inspectors and that this agreement was given in order to allay those concerns. ~r~t>~iCFt ~ ~ ~-J `~ ~ , n+E arv of KERRVILLE, TEXAS October 2, 1997 Leonard Odom Kerr County Road and Bridge 4100 San Antonio Hwy Kemille, TX 78028 RE: Pavement Distress -Clearwater Paseo Dear Mr. Odom Upon inspection of the City infrastructure placed with the Kerr County Jail, large longitudinal cracks were noted by city inspectors on Clearwater Paseo Drive. Several of these cracks extend through the surface and base course, to the subgrade. As per the agreement between the City of Kemille and Kerr County dated November 6, 1995, Kerr County is responsible for the upkeep and maintenance of the portions of Clearwater Paseo constructed with the County Jail for a period often (10) years. This letter has been sent to inform you of the pavement distress nn Clearwater Paseo. I am sure that upon viewing the site, you will see the potential for larger problems at this street unless these cracks are sealed. Please call me if there are questions regarding this letter. Ilse remai»ing portion of Clearwater Paseo is to be constructed according to the City of Kerrville Subdivision Specifications. The County Road and Bridge Department will be responsible for the srpkeep and maintenance of Clearwater Paseo Drive from the C~11-de-Sac to the existing road tie for a period of ten (] 0) years beginning upon the date in which this maintenance agreement is signed and rietrrmed to City Hall.
