CONTRACT BETWEEN THE OFFICE OF COURT ADMINISTRATION AND KERR COUNTY PRESIDING JUDGES ASSISTANCE PROJECT STATE OF TEXAS COUNTY OF TRAVIS UCA CONTRACT NO. 98-012 CJD Grant No. SF-98-A11-10969 I. CONTRACTING PARTIES This contract is by and between the Office of Court Administration, ("Grantee") and Kerr County, ("Service Provider") and in aid of CJD Grant No. SF-98-A11-10969 titled Administrative Presiding Judges Assistance Project. This project is also funded in part by state appropriations to the state Office of Court Administration. It is understood by all parties that payment obligations created by this contract are conditioned upon the availability of State or Federal funds appropriated or allocated for the payment of such obligations. The term of this contract shall commence on September 1, 1997, and shall end on August 31, 1998, unless extended or terminated as otherwise provided for in this contract. II. MONITORING The Office of Court Administration, Grantee, is responsible for closely monitoring Kerr County, Service Provider, and the exercise of reasonable care to enforce all terms and conditions of the grant. The Service Provider agrees to fully cooperate in the monitoring process. III. RECORDS Requirements of the Uniform Grant and Contract Management Standards (UGCMS) promulgated pursuant to Section 783 of the Government Code are adopted by reference as part of this contract, including the contract provision as in Section 36, Common Rule of OMB, of the above standards. The GRANTEE AGENCY SHALL keep all project records. Records shall be retained for at least three (3) years following the closure of the most recent audit report and until any outstanding litigation, audit or claim has been resolved. The previous contract was rejected by the Criminal Justice Division of the Governor's Office and we must re-execute contracts that follow the format specified by that Division. However, the substantive terms of the contract have not changed. Please review the contract, sign, and forward to the Honorable Stephen Ables, Presiding Judge for the Sixth Administrative Judicial Region for signature as well. At that time, the contracts should be returned to the OCA and a copy will be sent to each of you. The particular form of this contract has already been approved by the Criminal Justice Division so I anticipate little delay in obtaining their final approval.
