After a closed session and discussion the following
Actions were taken.
1. A motion made by Judge Denson and seconded by Judge
Abler to authorize Tommy Tomlinson to employ and Independent
Audit Firm to perform an audit on Recar as provided by the
Operating and Managing Agreement. Sa approved by a vote of
3-@-@.
~. A motion made by Judge Denson and seconded by Judge Abler
to authorize Tom Pollard, Attorney, to send a 30 day
Termination Notice to contractor as provided by the Operating
and Managing Agreement (E,@1). So approved by a vote of 3-@-Q~.
3. A motion made by Judge Denson and seconded by Judge F'rahl
to authorize Tom Pollard, Attorney, to send to contractor a 3Q~
day Notice to correct matters of noncompliance and/or take
action on any other remedy as provided under the Operating and
Managing Agreement (2.@3>. So approved by a vote of 3-0-0.
4. A motion made by Judge Denson and seconded by Judge Abler
to authorize Tommy Tomlinson to investigate and pursue all
available appropriate penalties and remedies regarding matters
disclosed by audit. So approved by a vote of 3-Q~-@.

1. A motion made by Judge Denson and seconded by Judge Ables to authorize Tommy
Tomlinson to employ an Independent Audit Firm to perform an audit on Recor as
provided by the Operating and Managing Agreement. So approved by a vote of 3-0-0.
2. A motion made by Judge Denson and seconded by Judge Ables to authorize Tom Pollard,
Attorney, to send a 30 day Termination Notice to contractor as provided by the
Operating and Managing Agreement (2.01). So approved by a vote of 3-0-0.
3. A motion made by Judge Denson and seconded by Judge Prohl to authorize Tom Pollard,
Attorney, to send to contractor a 30 day Notice to correct matters of noncompliance
and/or to take action on any other remedy as provided under the Operating and Managing
Agreement (2.03). So approved by a vote of 3-0-0.
4. A motion made by Judge Denson and seconded by Judge Ables to authorize Tommy
