BOX 29928 • SAN ANTONIO, TEXAS 78284-3601 • (210) 615-1110 December 12, 1997 Roadway Material Approved for Transfer Rider 43, SB 370 The Honorable Robert Denson Judge of Kerr County County Courthouse Kerrville, Texas 78028 Dear Judge Denson: In response to your letter, dated November 26, 1997, concerning roadway material under Rider 43, we have identified certain roadway material approved for transfer to your county. Attached is a list of roadway material approved for transfer to your county. This list includes a description of the material, the quantity, and the location of our existing stockpile or the project from which this material was generated. The approved material on the attached list is hereby furnished for your use with the following conditions: 1. The County shall provide all personnel, equipment, and incidentals necessary for safely loading and hauling the roadway material. If traffic control is required at the existing stockpile, it shall be in accordance with the Texas Manual on Uniform Traffic Control Devices ('TMUTCD). 2. The County shall contact Mr. Wayne Pehl, Kerrville Maintenance Supervisor, at (830)257-8444 at least 48 hours before loading and hauling material from any stockpile to make any necessary arrangements far inventory of the materials during and after the hauling. When necessary, Mr. Pehl will coordinate with other Maintenance Supervisors on stockpiles located in other Maintenance Sections. The County shall complete all loading and hauling of the material by February 28, 1998. 3. The County agrees to use the material in accordance with House Bill 1, Rider 43 of the 75th Legislature. 4. The Texas Department of Transportation does not warranty or guarantee the performance of any material transferred to the County. The County shall, to the extent practical, leave the existing stockpile site in a clean and safe condition.
