ORDER NO. 4149 AP'P'ROVAL OF RENEWAL OF CONTRACT WITH THE OFFICE OF COURT RDMINISTRATION On this the 25th day of August 1997, upon motion made by Commissioner Baldwin, seconded by Commissioner Oehler, the Court unaniAOUSly approved by a vote of 4-0-0, the renewal of contract with the Office of Court Administration to receive funding of the Sixth Administrative Judicial Region and authorize the County Judge to sign same. PRESIDING JUDGES ASSISTANCE PROJECT CONTRgCT 1. This contract is in aid of the Assistance to the Administrative Judicial Regions F'ro.ject of the state Dffice of Court Administration, funded in part by state appropriations to the state Office of Court Administration and in part 6y a grant for Fiscal Year 1998 to the state Office of Court Rdministration from the Governors Office, Criminal Justice Division, titled: Rdministrative Presiding Judges Assistance Project. 2. Statement of Services to be Performed: The State of Texas, through the state Office of Court Administration, will provide certain funds for payment of solar^y expenses for an administrative assistant or assistants to the Presiding Judge of the Sixth Administrative Judicial Region. To promote the efficiency and effectiveness of the administrative functions performed for the Sixth Administrative Judicial Region, Kerr County agrees to provide an employee or employees for the Sixth Administrative Judicial Region. The administrative assistant or assistants will be employees of Ker'r• County, with the same eights and benefits now enjoyed or hereafter granted to employees of Kerr County and the same responsibilities of said employees. The administrative assistant or assistants shall be chosen 6y, and serve at the will of, the Presiding Judge of the Sixth Administrative Judicial Region. The duties performed by an administrative assistant include assisting with the assignment and coordination of visiting judges' schedules, maintaining records for judicial assignments within the region preparing claims for' the judicial assignments within the r^egion, preparing claims for the visiting judges, and such other duties as may be necessary for' the efficient administration of justice in the Administrative Judicial Regions. 3. The state Dffice of Court Administration is responsible for monitoring the use by Kerr County of the funds provided and the exercise of reasonable care to enforce all terms and conditions of the grant. 4. Requirements of the Uniform Grant and Contract Management Standards_ tUGCMS) promulgated pursuant to 783.GDE, Texas Government Code, are adopted by reference as part of this contract. The county shall establish records that comply with the requir^ements of UGCMS and the terms of the grant. Recar'ds shall be preserved for' three t3> years for inspection by the state Office of Court Administration or by any state or federal agency authorized to inspect the same. v. Pasis for Calculating Reimbursable Costs: The state Office of Court Administration agrees to r-eimburse Kerr- County in an amount not to exceed X25,892.99 for a the per-iod September 1, 1997 through August 3i, 19998, for the salary and r-elated benefits of the administrative assistant or assistants For- the Sixth Administrative Judicial Region, payable in twelve {12) monthly installments. Reimbursable costs shall include the actual salary payments to the designated administrative assistant or assistants to the F'r-esiding Judge plus fringe benefits. Reimbursements will be contingent upon receipt of a signed statement fr-om an authorized county official listing the salary and fringe benefits amount to be incurred by the county for the administrative assistant or assistants to the Presiding Judge. Any change in the amounts to be incurred by the county during the per-iod of this contract shall communicated in writing to the state Office of Court Rdministration with thir-ty {30> days thereof. 6. In the event of a default of Kerr County, the state Office of Cour-t Administration may cancel or- suspend this contract and Ker-r^ County shall be entitled to recover for all services provided pr-ior- to the cancellation date or shall repay any funds advanced for services not pr-avided as of the contr-act date. 7. All applicable licenses, legal certifications, or inspections required for the ser-vices and all applicable state and federal laws, and local ordinances must be complied with by Ker-r• County. Failure to comply with this r-equirements shall be treated as a default. 8. The ter-ms of this contract are expressly understood to be in full force and effect on and after- September- 1, 1997. 9. This contract shall automatically ter-urinate on August 31, 1998, provided that, if a successor Presiding Judge be appointed dur-ing the per^iod of this contract who resides in a county other than Kerr- County and the offices of the Sixth Administrative Judicial Region are removed to another cotenty, then this contract shall expire upon the actual date of removal of offices fr-our Kerr County.
