January 22, 1997 Ken County Commissioners Court Kerr County Courthouse Kerrville, Texas 78028 Attention of: Commissioner Butch Lackey RE: Automobile Bodies in Third Creek and Flat Rock Lake Dear Commissioner Lackey and Members of the Court: Regarding our conversation today at UGRA and the subject matter, we offer the following: UGRA will request that our field service staff through the use of a motorized boat, inspect the lake in search of the subject auto body, determine to the best of our ability, its mobility and the requirements to remove the same from the lake. We will also sample the waters near the auto body to determine any pollution as a result of the object in the lake. This, of course, is based on the assumption that there is an auto body in Flat Rock Lake as a result of the October 28, 1996, flooding event in the Guadalupe River basin. 2. Subsequent to our gaining some intelligence as to the location of the car in the Flat Rock Lake, we might consider approaching the Kerrville Fire Department rescue team to determine any interest on their part to use this situation as a training exercise. UGRA has an interest in seeing the three to four auto 'oodies removed from Third Creek just prior to its confluence with Flat Rock Lake. It is our understanding that this matter has been before the Court at previous meetings. We would like to work with the Court on resolving this issue also. It appears that the Taylor operation may encroach on the floodway of Third Creek. If this is the case, Mr. Taylor will have to modify his operations by relocating several of his cars to another location if adequate space is not available at the Third Creek site. If Mr. Taylor is in violation of the FEMA program and we do not require his conformance, the Court, individually and collectively, as the program's sponsor, has an unprotected liability and the citizens of Kerr County are subject to lose the Federal flood insurance benefits. Should the irrigation application be from connectable hoses to hose bibs or other devices accessible to the public, that those points be signed to warn uninformed persons of the potential water quality issues. Some recommended signage could include the following message, "Not for Drinking" or any other such appropriate warning. The County may want to consider the possibility of extending the well water lines to the livestock washdown areas as well, and for other cleaning uses. Good water stewardships should encourage all of us to look at conserving the ground and surface water resources whenever possible.
