WHEREAS, -i"s:f2 ci!~<_j;_f:: t; I_ if?%<~fi~ Denton County ~heri~f°~s Department _. ,, Sheriff Frances Kaiser Kerr County 400 Clearwater Paseo Kerrville TX 78028-5387 Dear Sheriff Kaiser: Re: STATE OF TEXAS PAROLE REVOCATION WARRANTS Recently, at my request, the Denton County Commissioners Court unanimously passed a resolution (copy enclosed) asking the 75th Texas Legislature to allow counties to deliver prisoners on outstanding parole revocation (blue) warrants directly to State Jails or charge the State a $35.00 a day fee for keeping same in our county jail. Presently, prisoners arrested on blue warrants are detained at county jails until a revocation hearing takes place. This process can take upwards to ninety (90) days. The entire cost and responsibility for care, cost and custody rests upon the county for a State inmate. I have forwarded a copy of this resolution to our State legislators, with a request for their assistance Bn the next legislature, to amend the law allowing us to charge for or deiiver these inmates i:o State Jaii andior prisons. As you know, we are required by the State of Texas to apprehend and hold prisoners on parole revocation warrants. Denton County Commissioners' Court resolution 127 North Woodrow Lane, Suite 300 • Denton, Texas 76205-6397 • (817) 898-5700 • 434-1551 (Metro) • (817) 898-5605 (FAX) RESOLUTION RE: STATE OF TEXAS PROCEEDINGS BEFORE THE "BLUE WARRANT" REQUIREMENTS COMMISSIONERS COURT AND THEIR COSTS TO DENTON COUNTY DENTON COUNTY, TEXAS NOVENLBER 5, 1996 The Commissioners Court of Denton County, Texas, meeting in special session the 5th day of November, 1996, considered the following resolution: WHEREAS, The State of Texas issues arrest warrants ("blue warrants") for parole violators, and the Elected Sheriff of Denton County artd his Deputies are required to arrest, transport, detain, house, feed and care for these State of Texas parole violators; and WHEREAS, The Elected Sheriffof Denton County and his Deputies are required to detain, house, feed and care for these State of Texas parole violators for as long as 90 days; and WHEREAS, The citizens and taxpayers of Denton County are thereby forced to fund the arrest, transportation, detention, housing, feeding and care of these State of Texas parole violator: and WHEREAS, This requirement to arrest, detain, house, feed and care for those State of Texas parole violators flamounts to an unfunded mandate that creates a severe financial burden on the citizens of Denton County; and WHEREAS, The State of Texas has deemed that Denton County is not eligible for reimbursement for the expenses incurred in the arrest, transportation, detention, housing, feeding at~d care of these State of Texas parole violators. NOW, TI~REFORE, BE IT RESOLVED, that the Commissioners Court of the county of Denton, Texas hereby requests that the Legislature of The State of "texas, meeting in it's 7th session, in Austin, Texas to change the requirements to allow Denton County to be reimbursed at the rate of $35.00 per day for the arrest, transportation, detention, housing, feeding and care of these parole violators on behalf of the State of Texas, or allow these parole violators to be immediately placed in a state facility.
