As I mentioned to you last week in the hallway, the Commissioners Court does not control the fact of Ketch`s dateniion and if he can make it to the Court to participate in the otherwise pxaptrly-posted open meeting, then that would be fine. The Courts responsibl7ity is to provide an open meeting, not to assure any particular person's participation. Furthermore, as you know, the Commissioners do not control the function of tt1.e jail or'the conditions of detention. If the Court is concerned about some of ~e problems raised by Kelcb, then it may choose to distance itself from the situation by so stating in open court. You may expect that the Sheriff will attribute many of the problems mentioned by Ketch to be due to inadequate funding. In short, }rou mould be suod by Mr. Ketch for virtually any reason. If you don't respond to bis reyueri to be placed on the agenda, you could certainly be accused of denying him access to his governmcni however, that claim would have to be evaluated is light of what your nesponsibilitieg, in fact, arc.
