See Agenda Request Guidelines. ~-.. _ Memorandum TO: Commissioners' Court FROM: Franklin Johnston, P.E., County Engineer DATE: June 2, 1997 RE: Lone Star Gas Right-of--way at FM 1341 Kerr County received a letter from Lone Star Pipeline requesting a reimbursement of $41,791.00 for relocation of a gas line under FM 1341. This request is based upon the belief by Lone Star Pipeline Company that TXDOT acquired the right-of--way from Kerr County. In discussion with Bill Tucker, P.E. Area Engineer, TXDOT and Mike Coward, TXDOT, it appears the right-of--way in question was acquired by TXDOT, not by Kerr County, and their acquisition had no easements or encumbrances. Bill Tucker also expressed concern about this issue holding up the current reconstruction of 1341. Since this is a legal question, I recommend this be turned over to the County Attorney for resolution. .-.. The gas line as it exists, does not conform to current cover requirements and conflicts with the proposed construction in this area. To date, this unadjusted utility has not significantly affected project progress and operations, but construction operations have progressed to the point where this unadjusted utility will soar begin to adversely affect project progress. It is therefore, critical that this utility be adjusted as soon as possible to avoid additional project delays and the additional costs that accompany decays. Recent discussions with your office indicate that lone Star is going to request that Kerr County fund the adjustment of this line. It is my understanding that this request is based upon Lone Stars belief that their easement predated the purchase of right of way for the roadway. Our position is that we acquired the right of way from Kerr County with no encumbrances an the title. We request that you proceed with the adjustment as soon as possible and pursue the reimbursement issue concurrently with the relocation. If you wait until this issue is settled, several more months will pass, and additional delays will occur. If this happens, the possibility exists for damage claims due to delays to be filed against the Department of Transportation and passably Lone Star Gas.
