In particular, private roads in the ETJ must meet only the standards of the city and not the county." This being the case, it does not seem appropriate that the county engineer sign these plats stating it is in compliance with the county subdivision rules and regulations. Thisrs technically not correct. It should be the city planning and zoning commission (or city council in smaller cities) andlor the city engineer sign these plats stating they are in compliance with the city rural subdivision ordinances. After they are approved and signed-off by the city, the commissioners court could approve the plat for filing by the county clerk. This would simplify the approval process since it would not have overlapping regulations which do not mesh completely. Sincerely, Franklyn J ston, P. . Actually, this was discussed last year in context of the city establishing a minimum 5 acre rule and requesting we do the same. During the course of several meetings we discussed the city being the more appropriate entity to do physical inspections and supervision of developments in the ETJ. In particular, private roads in the ETJ must meet only the standards of the city and not the county. You have told us on occasion that the city road standards are more stringent and exceed ours therefore, it is only logical to do it this way. I would appreciate you correcting me if anything stated herein is inaccurate. Full and consistent disclosure and application of our rules and policies serve everyone best.
