TUCK and MARK PITTMAN, acting by and through its duly authorized Managing Partner, MICHAEL E. TUCK (hereinafter called "M&M"), and the COUNTY OF KERB, a political subdivision of the State of Texas (hereinafter called "KERB COUNTY"), have made and entered into this Agreement, in consideration for the mutual exchanges of promises between the parties as hereinafter described: .. III. ENTIRE AGREEMENT This Agreement constitutes the entire agreement between M&M and 1 ,n t ~ KERB COUNTY, and supercedes any prior understanding or written or oral agreements between the parties respecting the within subject matter. It shall not be amended, altered or changed, except by written agreement signed by the parties hereto. IV. APPLICABLE LAW This Agreement shall be construed under and in accordance with the laws of the State of Texas, and all obligations of the parties created hereunder are performable in Kerr County, Texas. SEVERABILITY If any one or more of the provisions contained in this Agreement for any reason shall be held to be invalid, illegal or enforceable in any respect, such invalidity, illegality or unenforceability shall not affect the other provisions hereof, and this Agreement shall be construed as if such invalid, illegal or unenforceable provision had never been contained herein.
