Leonard Odom, Jr. DATE: Apri128, 1997 RE: Moore Ranch Road We were asked to report on the status of Moore Ranch Road. As we discussed with the Court, this is not on the list of roads maintained by Ken County Road & Bridge. The only record we could find that might be this road is a 38 year old list (attached) showing a Tom Moore. Is this the road in question? If it is, it has not appeared on a list for maintenance since 1959. Someone also suggested this road had been discussed in Court recently. Our records show that the only Moore road addressed since our administration is the one known as T.J. or Jasper Moore Road (mapped as Moore Ranch Road). Attached is Court Order #22855 accepting 1.05 of that road and changing the name to Seago. All of the following information is based upon the road (Moore Lake Road) shown in L-12 of TRC 1990 ,,.,_ map (the one we use). Even though part of Moore Lake Road has a deeded right-of--way, by the actions of the landowners the public did not have access to this road until recently. Abandonment of a public roadway by statue is 20 years and there is an Attorney General opinion of 15 years. This road was behind a locked gate preventing maintenance or access for at least that long and maybe as long as 38 years. Attached is a drawing and notes from Lee Voelkel showing the deed of this road. Part of the deeded road is that portion of Felix Fisher as it comes off Hwy 39 (pink). Part is Moore Lake Road (green). You will also note there is a gap of 1835.7 ft. that is not recorded in the deeded road (orange). A real hazard exist in this area. There is an extreme drop offthat would need widening, possible guardrails, additional easement, and replacement of fence. The deeded easement is 40 ft. and by County standards should have a 18 ft. surface with 2 ft. shoulder. ~`It would not be possible to build such a road in the area where this hazard exist. If the Court chooses to accept this road, it will need 3/4 mile of reconstruction and could only be 10 ft. wide. The policy has been, when a road does not meet County standards that landowners are asked to participate in the cost of bringing the road up to standards. Are the citizens with land adjacent to this road willing to participate by giving material and/or putting money in escrow to pay for the reconstruction and surfacing of this road? According to Kerr County Appraisal District there are two parcels of land adjacent to this roadway ..-. (Moore Lake Ranch and Camp Mystic) . Camp Mystic does not use it. Therefore, it serves only Moore Lake Ranch. The cost to build an 18ft. wide road to County standards would be approximately $50,000.00. If the Court grants a variance, the estimated cost to reconstruct a 10 ft roadway with landowner(s) furnishing the material would be $16,000.00. If the base material had to be purchased, it would cost approximately $26,000.00. As shown on the attached Court Order # 22855, the Court accepted maintenance on an access road for Moore Lake Ranch August 28, 1995, at a cost of approximately $16,000.00. This gave Moore Lake Ranch egress and ingress to Hwy 39 with 1.05 miles of County maintained roadway by the name of Seago. Should the Court deem that we have the responsibility to reconstruct this road we will need the following: 1. A Court Order of acceptance to add the road to our list; 2. An official name for the road; 3. A variance to build a 10 ft. roadway; 4. Direction on how to address the hazardous area; 5. Funds budgeted in the 97/98 budget for reconstruction.
