PETITION TO VACATE SUBDIVISION PLAT
TO THE HONORABLE KERB COUNTY COMMISSIONERS' COURT:
Now come James Albert Boyd and wife, Bettie Lou Boyd (Petitioners), to file this Petition to
Vacate the Plat of the Real Ranch Estates Subdivision, Section One and Section Two filed in the
Kerr County Plat Records on July 17, 1978, and recorded at Volume 4, Pages 128 and 129, of the
Ken County Plat Records and in support thereof would respectfully show this Court the
following:
Petitioners own all of the ten (10) lots in the Real Ranch Estates Subdivision, Section One and
Section Two. Petitioners acquired the Real Ranch Estates Subdivision, Section One by purchase
of Lot 1 and Lot 2 from Lane Wolters and Patricia E. Wolters. This deed is recorded in volume
809, page 396 of Real Property Records of Kerr County. Lot 3 and Lot 4 of Section One was
purchased from Phyliss Ann de Vore and is recorded in volume 809; page 391 of Real Property
Records of Ken County. Lots in Section Two of the Real Ranch Estates Subdivision were
acquired as follows: Lot 5, Lot 6, Lot 7 and Lot 8 were acquired from Shawn Eric Southworth
and Brenda Burns Southworth. This deed is recorded in volume 809; page 404 of Real Property
Records of Kerr County. Lot 9 and Lot 10 from Phyliss Ann de Vore. This deed is recorded in
Volume 809; page 391 of Real Property Records of Kerr County. All Lots were acquired on or
about July 27, 1995. A true and correct copy of the deeds are attached hereto as Exhibit "A" and
is incorporated herein by reference, word for word, verbatim. Petitioners own and unplatted
104.42 acre tract contiguous to the Real Estates Subdivision, Section One and Section Two.

Petitiioners seek to cancel all of the Subdivision including any dedicated easements or roadways
and seek to re-establish the property as an acreage tract as it existed before the Real Ranch
Estates Subdivision, Section One and Section Two. The cancellation of all of the Subdivision
"~ does not interfere with the established rights of any purchaser of the reason that Petitioners own
all of the Subdivision and agree to the cancellation.

Petitioners pray for an order of this Commissioner's Court authorizing them as owners of the
Real Ranch Estates Subdivision, Section One and Section Two to file and instrument canceling
Real Ranch Estates Subdivision, Section One and Section Two. The said instrument will
describe the Real Ranch Estates Subdivision, Section One and Section Two that is canceled.

Pursuant to the provisions of Section 232.008, V.T.C.A. Local
Government Code, the owners of the property, James Albert Boyd
and wife, Bettie Lou Boyd have filed an Application for Revo-
cation of a Kerr County Subdivision Plat.
The subdivision plat is recorded in Vol. 4, pages 128 and 129
of the Kerr County Plat Records and the Application is on file

PETITION TO VACATE SUBDIVISION PLAT
TO THE HONORABLE KERB COUNTY COMMISSIONERS' COURT:
Now come James Albert Boyd and wife, Bettie Lou Boyd (Petitioners), to file this Petition to
Vacate the Plat of the Real Ranch Estates Subdivision, Section One and Section Two filed in the
Kerr County Plat Records on July 17, 1978, and recorded at Volume 4, Pages 128 and 129, of the
Kerr County Plat Records and in support thereof would respectfully show this Court the
following:
Petitioners own all of the ten (10) lots in the Real Ranch Estates Subdivision, Section One and
Section Two. Petitioners acquired the Real Ranch Estates Subdivision, Section One by purchase
of Lot 1 and Lot 2 from Lane Wolters and Patricia E. Wolters. This deed is recorded in volume
809, page 396 of Real Property Records of Kerr County. Lot 3 and Lot 4 of Section One was
purchased from Phyliss Ann de Vore and is recorded in volume 809; page 391 of Real Property
Records of Kerr County. Lots in Section Two of the Real Ranch Estates Subdivision were
acquired as follows: Lot 5, Lot 6, Lol 7 and Lot 8 were acquired from Shawn Eric Southworth
and Brenda Burns Southworth. This deed is recorded in volume 809; page 404 of Real Property
Records of Kerr County. Lot 9 and Lot 10 from Phyliss Ann de Vore. This deed is recorded in
Volume 809; page 391 of Real Property Records of Kerr County. All Lots were acquired on or
about July 27, 1995. A true and correct copy of the deeds are attached hereto as Exhibit "A" and
is incorporated herein by reference, word for word, verbatim. Petitioners own and unplatted
104.42 acre tract contiguous to the Real Estates Subdivision, Section One and Section Two.

Petitiioners seek to cancel all of the Subdivision including any dedicated easements or roadways
and seek to re-establish the property as an acreage tract as it existed before the Real Ranch
Estates Subdivision, Section One and Section Two. The cancellation of all of the Subdivision
does not interfere with the established rights of any purchaser of the reason that Petitioners own
all of the Subdivision and agree to the cancellation.

Petitioners pray for an order of this Commissioner's Court authorizing them as owners of the
Real Ranch Estates Subdivision, Section One and Section Two to file and instrument canceling
Real Ranch Estates Subdivision, Section One and Section Two. The said instrutent will
describe the Real Ranch Estates Subdivision, Section One and Section Two that is canceled.
