Dear Sir: The Justices of the Peace of Precincts Two, Three, and Four request about one hour time in Executive Session concerning pressing personnel matters. Please expect all three Justices to be present with the possible addition of Precinct One. October 14, 1997 TO THE HONORABLE MEMBERS OF THE KERR COUNTY COMMISSIONER'S COURT: Gentlemen: It has come to the attention of the Judges of the Justice Precincts Two, Three, and Four that Pat Knox Cardin, the Judge of Justice Precinct One has come to the decision that she is unable physically to carry out her duties as Justice of the Peace. For whatever reason, she has elected not to bring this matter to you herself. Judge Knox requested Judge Wright to take Judge Knox's agreed duties last week. Judge Knox has stated that she, Judge Knox, was unable to perform magistrate duties at the jail that she has previously agreed to, perform inquests she is required to hold, and that she believed that she was not required to attend to office duties according to the law. She states that her duties can be performed at home. We all understand that people can be physically injured and be temporarily unable to attend to duties but Judge Knox has decided to permanently become disabled. We understand that some people may become disabled by illness or injury and we do not expect anyone to be sanctioned solely on that basis. We do not mean to discuss the extent or possibility of the disability of Judge Knox. We do object to Judge Knox's determination not to perform her required and agreed duties in these respects: 1. All buildings that she should perform her duties in are handicap accessible with the exception of in the field inquests which could be reassigned by on-call magistrates. Her office building is completely handicap accessible including the restrooms. 2. Her office is handicap accessible and if for some reason not accessible it is her required duty to make it so. The location and building arrangement is compatible with A.D.A. 3. The jail is handicap accessible and she is able to function there if she chooses to do so. 4. We have no knowledge of Judge Knox's effort to accommodate herself and belief that she made no effort to do so, rather, she has inferred strongly that she has no intention of attempting to function in her official capacitates but instead is depending on the remaining Judges to carry her load while she remains at the house. She has told us that she is able to make car trips to the coast of Texas but unable to arrive at her office. We believe strongly that this is incongruent with total disability. We have chosen to make this presentation to you in Executive Session rather than in open meeting, as we could have, because we are not attempting to humiliate Judge Knox but we also agree that she has to make a decision about her office and duties or voluntarily remove herself from the bench. We ask the Commissioners to ask Judge Knox for the record if she intends to take her position as Justice of the Peace or make that position vacant.
