Commissioners Court (,,, Kerr County Courthouse ~n}V Kerrville, Texas 78028 Gentlemen: Local Government Code Sec. 118.131 authorized the commissioners court to set reasonable fees for services by the offices of the sheriff and constable. The fees must be set prior to October 1 of each year to be effective January 1 of the following year. This has been done annually, however the District Clerk's office has been charging a "sheriff's venire fee" of $5.00 on all civil cases filed. This fee at one time appeared on the list of sheriff's fees approved by the court but at some point and for whatever reason was probably inadvertently omitted. This fee is a good source of revenue for the county. I would therefore recommend to the court that this fee be added to the fee schedule, that it be increased to $15.00 and reallocated and renamed "Sheriff's Bailiff fee". The District clerk's office files approximately 825 civil cases annually, the County Clerk's office files approximately 160 civil cases annually. Based on these figures the fee would generate $14,000 + annually in county revenue. I would have no recommendation as to assessing the fee in justice courts as I am unfamiliar with the amount of cases filed and the necessity of bailiffs.
