BETWEEN the Owner: KERR COUNTY COMMISSIONERS COURT KERR COUNTY TEXAS 700 MAIN STREET KERRVILLE, TEXAS 78028 and the Contractor: INSIDE STORY ROUTE 2, BOX 220E FREDERICKSBURG, TEXAS 78624 the Project: Window Treatment -Horizontal Blinds -First Floor Kerr County Courthouse Location: Kerr County Courthouse, 700 Main Street, Kerrville, Texas 78028, and as further described in the Plat records of Kerr County, Texas. with Contract Documents prepazed by the Architect: Michael Neal Walker 1303 Vesper Lane Kerrville, Texas 78028 The Owner and Contractor agree as set forth below: ARTICLE 1 THE WORK The Contractor, having visited the site and examined the conditions affecting the Work, hereby proposes and agrees to famish all labor, materials, equipment, and appliances, and to perform operations necessary to complete the Work as required by the Contract Documents for Window Treatment, Horizontal Blinds of the First Floor Windows of the Kerr County Courthouse for the Owner as described in the Drawings and Specifications. ARTICLE 2 TIME OF COMMENCEMENT AND COMPLETION The Work to be performed under this Contract shall be commenced on ;subject to authorized adjustments, Completion shall be achieved not later than Aprit 1, 1997. Due to ongoing work by others, Contractor may not be able to access and install eleven (11) units in the Auditor Offices until latter March, 1997; however, the balance of twenty three (23) units shall be installed at eazliest possible date for delivery and installation. kccagrwd -Owner/Contractor Ageement -Page 1 of 3 ARTI i CONTRACT SUM The Owner shall pay to the Contractor in current funds for the performance of the Work, subject to additions and deductions by Change Order as provided in the Contract Documents, the Contract Sum of TWO THOUSAND EIGHT HUNDRED AND NO/100 DOLLARS ($2,800.00). ARTICLE 4 PROGRESS PAYMENTS Contractor may submit Application for Payment to the Architect who shall review the Application and forward certified copies to the Owner for payment. The Application for Payment shall show that portion the Contract Sum properly allocable to labor, materials and equipment incorporated into the Work and materials and equipment suitably stored at the site at the time of Application. Within twenty (20) working days of receipt by the Owner of the Archi- tect's certified Application for Payment, the Owner shall pay Contractor ninety (90%) of the amount due, less the aggregate of previous payments made by the Owner to Contractor; and less such amounts as the Architect shall determine for all incomplete work and unsetfled claims. All retainages from progress payments shall be withheld without liability for interest. ARTi 5 FINAL PAYMENT Final payment of the remaining unpaid balance of the Contract Sum shall be paid by the Owner to the Contractor within thirty (30) working days after: (1) the Work has been completed, (2) the Contract has been fully performed, (3) all matters related to mechanics and materiahnen's liens have been fully satisfied, including any statutory holding peri- od, and (4) a final Application for Payment has been issued by the Contractor and certified by the Architect.
