This date is the time set, per the Contract Documents and Change Orders Number 1 through 6,
as the date for Substantial Completion. Please find the attached back-up documents for the May
12 Commissioners Court Meeting, relative to the Rhodes Contract:
1. Final Certificate and Application for Payment (#7) and Certificate of Substantial
Completion. By the time Court meets on May 12, the attached Corrections List will most
probably be complete. However, to be on the safe side, since the Contractor is waiting
on special drain pipe pieces for ADA lavatories, we set possession date as May 12, 1997.
2. Please note the enclosed letter from Mr. Devore of Rhodes Construction concerning a
request for release of retainage amounts eazlier than the prescribed 30 day period for
settling liens, etc. The Contractor's point is understandable in that additional unforeseen
projects have been added to the Scope of Work; therefore, to keep his subcontractors and
suppliers content, he has had to pay to some of subs their retainage, as their Work has
been complete for some time. This is a legal question, to which counsel we recommend.
However, we see no problem with at a partial release, assuming legal counsel has no
problem with content of the enclosed releases.
3. On the matter of the Owner relinquishing claim of the $1,200 rebate to State Aire,
HVAC Subcontractor to Rhodes Construction, I believe that you have received the
enclosed letter (copy). Neither Lux Engineering nor our firm was made awaze of the
Subcontractor including this rebate to himself in the bidding process, which fact would
normally need to be done to make the bidding equitable, although we gladly approved
the higher Seasonal Energy Efficiency Ratio of 12. Technically, we find little basis for
this claim, as the rebates are intended for the owner or ratepayer, as an incentive to pay a
little more for better equipment that saves on future energy use. However, practically,
the County has received a portion of value in the net cost of the State Aire bid to Rhodes
Construction and the County, although we aze unsure of the amount. Plus, the County
will receive reduced energy costs, which is the intended purpose of this soon-to-be-
abandoned KPUB program.

Outside Rhodes' Contract:
1. Per the Court's direction at the last meeting, our review of the overall signage
requirement with Commissioner Letz has yielded a net increase of one sign, assuming
that the number of "no smoking" signs is five. One sign was added for the Historical
Commission, as the County Clerk plans to use the locked door for a separate entrance in
the future; meanwhile, the KCHC door sign could be mounted immediately below the
County Clerk's sign. If the Court doesn't want to pay for the KCHC sign ($150+/-), I can
take the expenditure to their Board at the next meeting. Due to the delay in getting the
bidding package amended and reviewed by those affected, we find that it is advisable, to
postpone consideration of the bids until the next Court Meeting. We will be bidding in 3
packages to attract local more specialized bidders:
1. One Building Directory.
2. Door and Directional signage (44 plus a unit price on "No Smoking" and
repetitive signage).
3. Parking Area Signage (10).
2. We hope to bring to Commissioners' Court by May 12 a final resolution to the
window covering (blinds) situation. We are insisting that the Supplier, Inside Story of
Fredericksburg, come closer to meeting specifications on "ease of operations". We do
not recommend payment until these issues are resolved.

The following list is a compilation of items observed by the Architect on awalk-through with the Contractor
on May 5, 1997, and subsequent review by Lux Engineering. The purpose of this list is to provide Substantial
Completion Certificate, then fmal acceptance for complete occupancy for the enfire Projeck This list is
hereby attached to the Certificate of Substantial Completion. Final acceptance by the Owner is dependent on
the Contractor successfully rectifying items on this list and is subject to a fmal observation, which will be
performed by the Architect and Engineer. Rectificafion of items on this list does not relieve the Contractor of
other specific requirements of the Contract Documents. Contract Time was extended to May 6, 1997 by
Change Order #6.
GENERAL:
1. Lubricate hazdwaze and hinges. Remove stain from hinges and other hazdwaze; remove paint from stained
wood. Paint or stain screw heads to match hardwaze.
2. Thoroughly clean all surfaces in unoccupied spaces, including outlets and switches .
3. Label all electrical panels, clearly and neatly.
4. Furnish to Owner's Building Superintendent surplus paint of each color and type, and other finish
materials (ceiling, wall covering, etc.)
5. Ftunish Keying Schedule for Operation & Maintenance Manual.
EXTERIOR
1. Complete priming and painting of wood windows and doors.
2. Clean exterior grounds of sucptus materials, paint, spills, and other refuse which aze a result of this Work.
AUDITOR 1 (and JPl):
1. Check balance and fan speed of HVAC due to excessive air noise on cooling cycle. It is warm in JP 1
Clerk and somewhat noisy in IP I.

1. Provide plated Phillips head screw fasteners and waterproofing at all penetration's hoods and caps affected
by this Work; supply 6" wide galvanized sheetmetal rain hood over refrigerant pipe entry into existing vent.
2. Place painted sheet patch over 2 split comers, lapping 2" minimum with sealant and screws; paint.
3. Stencil identifying names/numbers on condenser units (linked to electrical panels) with permanent paink
4. Sealant at all penetrations of masonry, etc. caused by this constmction.
5. Heating/Cooling refrigerant lines shall have support at 48" maximum spacing with insulation cushions at
all supports.
6. Remove excess, dismantled, and abandoned materials from attic crawl space and roof.

At this time, I would appreciate your consideration for releasing our retainage of $26,958.10,
which is 10% of our total contract amount of $269,581.00 for the work performed at the Kerr
County Courthouse.
I uriderstand that you may be somewhat apprehensive about this request, since the usual period
of payment on the retainage is 30 days after completion of the contract. However, the
completion of the contract has far exceeded its original completion date due to numerous
reasons, such as:
Delays for trials
Delays for jury selections
Delays for an unusual amount of change orders (which have been completed)
Not only do you retain 10% of our pay request, but we in tum retain 10% of our subcontractors
pay requests. This amount reflects their profits as well as ours. Therefore, you can see why we
would appreciate resolving this matter in a timely manner in order to satisfy everyone's needs.
We at Rhodes Commercial Construction have thoroughly appreciated the opportunity to work
with you and the cooperation that you have shown in the past. We hope that we will be given
the opportunity to work with you again.

The air conditioning equipment installed for the Kerr County courthouse
renovations is a higher Seer rating than specified. The KPUB rebates were
deducted from the bid price for low bid. Rebates are to be paid to the air
conditioning contractor. The benefit to the county is a higher Seer system than
specified, for increased energy savings.
