(Sheriff) ORDER N0. .'_'38c0 RF'F'ROVRI_ TO F'ASS RESOLUTION TO ALLOW COUNTIES TO DELIVER PRISONERS TO STATE JRILS OR CHARGE THE STATE A 535.00 FEE FOR KEEPING THE PRISONERS ~' On this the 7th day of January 1997, upon motion made by Commissioner Paldwin, seconded 6y Commissioner Oehler, the Court unanimously approved by a vote of 4-0-0, to approve passing a r^esol~_ition to allow co~_inties to deliver^ prisoners on o~_itstanding parole revocation (blue) war-r^ants dir^ectly to State ,Jails or charge the State a 535.00 fee for- keeping the prisoners in our- county ,jail. RESOLUTION STATE OF TEXRS "FLUE WARRANT" REQUIREMENTS AND THEIR COSTS TO KERR COUNTY WHERERS, The State of Texas issues arr-est warrants ("Flue War^rants") for parole violators, and the Elected Sheriff of Kerr County and her Dep~_ities are required to .._, arrest, transpor^t, detain, house, fee and car^e for these State of Texas parole violators;and WHERERS, The Elected Sher^i.ff of Kerr County and her Deputies are requir^ed to detain, ho~_~se, feed, and car^e for^ these State of Texas par^o1e violators for as long as 90 days;and WHEREAS, The citizens and taxpayers of Ker•r• County ar^e thereby for^ced to fund the arr^est, transportation, detention, ho~_ising, feeding and care of these State of Texas parole violators;and WHERERS, This requirement to arr^est, detain, house, feed, and care for^ those State of Texas parole violators amounts to an unf~..inded mandate that creates a severe financial burden on the citizens of Kerr Co~_mty;and WHEREAS, The State of Texas has deemed that Ker^r' County is not eligible for^ reimbursement for- the expenses inc~_irr^ed in the arrest, transportation, detention, ho~_ising, feeding and car^e of these State of Texas par^ole violator^s. F'AGE 31 NOW THEREFORE BE IT KNOWN: ,.-^ that the Commissioner's' Court of the County of Kerr, Texas hereby requests that the Legislature of "fhe State of Texas, meeting in it's 7:,th session, in A~.istin, Texas to change the req~.iirements to allow Kerr County to be reimbursed at the rate of $~5.0Q per' day far' the ar^r'est, tr'anspor'tation, detention, ha~_ising, feeding and care of these parole violator's on behalf a~f the State of Texas, or allow these parole violators to be immediately placed in a state facility.
