unanimously approved by a vote of 4-@-@, extending the lease
on the CityJCo~_inty Recycling Center.
FIRST RMENDMENT TO RECYCLING llROp'-OFF CENTER
LEASE AGREEMENT BETWEEN THE CITY OF KERRVILLE,
TEXAS, RND COUNTY OF KERR, TEXAS
This First Amendment is entered into by and between the
CITY OF KERRVILLE, TEXRS, a Texas home rule municipality
(hereafter called "City"), and the COUNTY OF N,ERR, TEXRS, a
s~_ibdivision of the State of Texas (hereafter called "County"),
for• the p~_irpose of amending that certain Recycling Drop-Off
Center Lease Rgreement dated December- 12, 1994, between City
and County, ("the Lease Rgreement").
WHEREAS, City and Co~.rnty exec~_ited the Lease Agr^eement for^ the
purpose of permitting the operation by City of a comm~_~nity
recycling center for the benefit of City and County r^esi.dents;
and
WHERERS, the City has obtained vario~_rs grants for the purpose
,.- of constructing capital improvements on Co~_~nty's property
which require the City to continue operation of the commtmity
recycling center for a period beyond the termination of the
initial lease term of the Lease Agreement;
and
WHEREAS, the City and Co~_inty find it mutually beneficial to
resolve any ~_tncer•tainty regarding the City's continued ~_ise of
the proper^ty which is the subject of the Lease Rgreement fore
the period req~_tir•ed by the City's oar-ions grant agreements;
NOW THEREFOP,E, for and in consideration of the following
promises and conditions, City and Co~..inty agree as follows:
1. Section c of the Lease Agreement shall be amended to read
in its entirety as follows:
-. Initial Term and Renewal. The initial. term of this
Agreement shall commence on Jan~_rary 1, 1995, and shall
terminate December 31, 2@@4. Thereafter, this
Rgreement shall be renewed automatically for successive
periods of five (5) years each, commencing on Jan~_iary
1,~0@S, ~_mless notice of termination is given either
by the County ar by the City at least 1 @ calendar- days
prior to the commencement date of the renewal term in
q~_~estion.

... City and County agree that except cis provided herein, all
other provisions of the Lease Agreement shall remain in full
force and effect.
