Money amounts were changed as per the budget. Otherwise same contract as last year. Should you desire to go over the contracts, they are filed with the County Clerks Office (Tammy) as part of our back up. We sign two each, one for the contracting agency and one for the County. K'STAR CONTRACT STATE OF TEXAS COUNTY OF KERR * WHEREAS, Kerr County, Texas ("COUNTY"), a political subdivision of the State of Texas, has the authority, through its county attorney, under Section 41.003 of the Texas Human Resources Code, to provide for services to and support of children in need of protection and care; and WHEREAS, K'STAR a Texas non-profit corporation, is engaged in the provision of shelter, counseling, guidance, and support for runaway children and other "at- risk" juveniles, and desires to enter into a contract with COUNTY to provide certain services to and support of the children of COUNTY who aze in need of protection and care; IT IS THEREFORE AGREED that: 1. K'STAR will provide services to the residents of COUNTY as follows: a. a short-term emergency shelter for youth in need and/or "at-risk"; b. food, clothing, counseling, and education to youth in need and/or "at-risk"; and c. facilities for residential placement of youths in need of protection o r other assistance. 2. This contract is not exclusive, and COUNTY, reserves the right to contract with additional patties for the provision of any and all services covered by this agreement. 3. K'STAR currently has and shall maintain a policy of liability insurance in the following minimum amounts: $300.000.00 Premises: Personal Injury 4. K'STAR agrees to operate under a policy of non-discrimination with regard to the provision of said services. Such policy shall prohibit discrimination on the basis of race, sex, age, religion, color, handicap, disability, national origin, language, political affiliation or belief, or other non-merit factor. Acts of discrimination shall constitute a material breach of this contract. 5. K'STAR finther agrees to adopt and maintain a policy that prohibits sexual harassment. Acts of sexual harassment constitutes a material breach of this contract. 6. K'STAR agrees to comply fully with any and all applicable laws, local, state, and federal, regarding work hours, safety, wages, social-security benefits, and/or workers' compensation. This clause places a duty to meet the requirements of such laws only if the law itself places such a duty on K' STAR. Acts in violation of any of those laws or ordinances constitute a material breach of this contract. TERM 7. The term of this agreement is one (1) year beginning on October 1, 1998 and ending on September 30, 1999, unless earlier terminated by either party on thirty (30) days written notice addressed to: COUNTY: Kerr County Judge 700 East Main Street Kerrville, Texas 78028 ,CONSIDERATION K"STAR: Chairman of the Board, K"STAR 820 Main Street, Suite 205 Kerrville, Texas 78028 8. K'STAR shall submit to the Kerr County Auditor an annual financial report itemizing all income and expenditures for the period covered by this agreement. K'STAR shall also submit to the Ken County Auditor an annual report which states the total number of youths that were provided services under this agreement and describes the services that were provided. 11. No moneys paid to K'STAR shall be expended for any purpose other than those specified above. Unless specifically provided for herein, no moneys may be expended for the provision of salaries to any person. 12. All books and records of K'STAR shall be open for inspection during normal business hours to any member of the public, the Kerr County Auditor, and to such persons as may be given that authority, in writing, by the Kerr county Auditor or the Ken• County Commissioners' Court. No clause shall, in any way, be construed to override the provisions of the Federal Privacy Act or other state or federal law or regulation concerning the disclosure of confidential or privacy matters. 13. CRISIS COUNCIL will provide services to the residents of COUNTY as follows: a. Intake and referral services for persons seeking family violence protective orders from the Kerr County Attorney's Office, and b. Maintain a "batterer's intervention program" designed to counsel and treat those who commit acts of family violence. 2. This contract is not exclusive, and COUNTY, reserves the right to contract with additional parties for the provision of any and all services covered by this agreement. 3. CRISIS COUNCIL currently has and shall maintain a policy of liability insurance in the following minimum amounts: $1,000,000.00 Premises: Personal injury $60,000.00 + $26.000.00 4. CRISIS COUNCII, agrees to operate under a policy of non-discrimination with regard to the provision of said services. Such policy shall prohibit discrimination on the basis of race, sex, age, religion, color, handicap, disability, national origin, language, political affiliation or belief, or other non-merit factor. No moneys paid to CRISIS COUNCIL, shall be expended for any purpose other than those specified above. Unless specifically provided for herein, no moneys may be expended for the provision of salaries to any person. 12. CASA will provide services to the residents of COUNTY as follows: a. Provide guardians ad litem for use by the courts in appropriate cases relating to juvenile matters, and b. Provide family studies and perform such other investigations services as requested by COUNTY. 2. This contract is not exclusive, and COUNTY, reserves the right to contract with additional parties for the provision of any and all services covered by this agreement. 3. CASA currently has and shall maintain a policy of liability insurance in the following minimum amounts: Premises: Personal Injury 4. CASA agrees to operate under a policy of non-discrimination with regard to the provision of said services. No moneys paid to CASA shall be expended for any purpose other than those specified above. Unless specifically provided for herein, no moneys may be expended for the provision of salaries to any person. 12. All books and records of CASA shall be open for inspecfion during normal business hours to any member of the public, the Kerr County Auditor, and to such persons as may be given that authority, in writing, by the Ken county Auditor or the Ken County Commissioners' Court.
