SAMPLE RESOLUTION for AWOS WHEREAS, the NAME OF SPONSOR desires to participate in the Innovative Finance Program to install an automated weather observation system at the (name of airport) and WHEREAS, the NAME OF SPONSOR hereby offers 25% of project costs to match 75% federal funds, currently estimated to be $20,000 in local funds; and WHEREAS, local funds will be available to meet project expenditures; and WHEREAS, the NAME OF SPONSOR agrees to operate and maintain the installed automated weather observation system for the useful life of the asset; and WHEREAS, the NAME OF SPONSOR hereby requests financial assistance from the Texas Department of Transportation for installation of the automated weather observation system; and WHEREAS, the NAME OF SPONSOR intends to name the Texas Department of Transportation as its agent for the purposes of applying for, receiving and disbursing all funds for these improvements and for the administration of contracts necessary for the implementation of these improvements; NOW, THEREFORE, BE IT RESOLVED, that the NAME OF SPONSOR hereby directs NAME OR POSITION OF INDIVIDUAL to execute on behalf of the NAME OF SPONSOR, at the appropriate time, and with the appropriate authorizations of this governing body, all contracts and agreements with the State of Texas, represented by the Texas Department of Transportation, and such other parties as shall be necessary and appropriate for the implementation of the improvements to the AIRPORT NAME. [ 12/17/97] T:~D42GRANIIFORM~RESOLUTION FOR AWOS.DOC CITY OF KERRVILLE, TEXAS RESOLUTION NO. 98- 105 COMMISSIONERS COURT OF KERR COUNTY, TEXAS RESOLUTION 110. 25177 JOINT RESOLUTION SUPPORTING APPLICATION TO TEXAS DEPARTMENT OF TRANSPORTATION'S INNOVATIVE FINANCING PROGRAM FOR FUNDS TO PURCHASE AND INSTALL AN AUTOMATED WEATHER OBSERVATION SYSTEM AT THE KERRVILLE/KERR COUNTY MUNICIPAL AIRPORT WHEREAS, the governing bodies of the City of Kerrville, Texas ("City") and Kerr County, Texas, ("County") joint owners of the Kerrville/Kerr County Municipal Airport ("the Airport"), desire to participate in the Texas Department of Transportation's ("TxDOT") Innovative Finance Program for the purpose of installing an automated weather observation system ("AWOS") at the Airport; and WHEREAS, the Airport Manager and the City's Director of Finance have identified funds in the Airport Fund which City and County can make available for the necessary local match of approximately $20,000.00 to fund installation of an AWOS; and WI IEREAS, the City Council of the City of Kerrville, Texas, and the Commissioners Court of Kerr County, Texas, find it to be in the public interest to request financial assistance from TxDOT for installation of an AWOS and make the necessary matching funds available to TxDOT in order to pursue the installation of an AWOS at the Airport; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KERRVILLE, KERR COUNTY, TEXAS AND THE COMMISSIONERS COURT OF KERR COUNTY, TEXAS: SECTION ONE. That the City and County offer 25% of project costs to match 75% of federal funds that would be used for the purpose of purchasing and installing an AWOS at the Kerrville/Kerr County Municipal Airport, currently estimated to be $20,000.00 in local funds. SECTION TWO. That if TxDOT agrees to use the funds to purchase and install the AWOS at the Airport, City and County will agree to: A. make local funds available to meet project expenditures; B, operate and maintain the installed AWOS for the useful life of the asset; and C. name TxDOT as its agent for the purpose of applying for, receiving and disbursing all funds for the improvements and for the administration of contracts necessary for the implementation of these improvements. SECTION THREE. That the City Manager is hereby authorized to execute on behalf of the City of Kerrville and Kerr County, as the owners of the Airport, at the appropriate time, and with the appropriate authorizations of the City Council and the Commissioners Court, all contracts and agreements with the State of Texas, represented by the Texas Department of Transportation, and such other parties as shall be necessary and appropriate f`or the implementation of the improvement to the Airport. We have a few more steps to take before any final decisions can be made. If you are still committed to this project and wish further consideration, you will need to have your governing body pass a resolution (sample enclosed) which provides the commitment of your city/county body to the project and pledges your financial resources. This resolution must be executed and returned by February 10 along with the enclosed Certification of Project Funds for your application to be considered in the final selection. Avery important item which you should keep in mind as you continue into the final selection process is your commitment to the future year costs of the AWOS for maintenance and monitoring. While we are exploring including 3 to 5 years of maintenance and monitoring in the contract for installation so federal funds will pay for 75% of these costs, years beyond the 3 to 5 year time span could be a sponsor responsibility in their entirety. Estimates for these costs can be between $2,500 to $3,000 a year. TxDOT will strive to participate in these costs in the future years, but no commitment can be made at this time. Deep in mind, that if your airport is selected as a recipient, all federal and state grant assurances will apply, including the continuance and operation of the asset for its useful life. Additionally, operating expenses of one to two telephone lines and utilities should also be contemplated as a sponsor expense. An Equal OppoRunity Employer Currently our best gross estimate, including at least three years of maintenance and monitoring, is around $80,000 for a turn key installation. However, until bids can be solicited, we will not have an exact amount. Based on our estimate, a financial commitment on your part would total $20,000 for the initial installation including three years of maintenance. Your initial share could be needed as early as May 1998 if anticipated schedules are met. Please review your commitment to this project in the long run and provide the above requested resolution by February 10, 1998.
