CONTRACT BETWEEN THE OFFICE OF COURT ADMINISTRATION AND KERR COUNTY PRESIDING JUDGES ASSISTANCE PROJECT STATE OF TEXAS OCA CONTRACT NO. 99-003 COUNTY OF TRAVIS CJD Grant No. SF-99-A11-12351 I. CONTRACTING PARTIES This contract is by and between the Office of Court Administration, as the Grantee Agency, and Kerr County, the Service Provider, and in aid of CJD Grant No. SF-99-All-12351 titled Administrative Presiding Judges Assistance Project. This project is also funded in part by state appropriations to the state Office of Court Administration. It is understood by all parties that payment obligations created by this contract aze conditioned upon the availability of State or Federal funds appropriated or allocated for the payment of such obligations. The term of this contract shall commence on September 1, 1998, and shall end on August 31, 1999, unless extended or terminated as otherwise provided for in this contract. II. MONITORING The Office of Court Administration is responsible for closely monitoring Kerr County and exercising reasonable care to enforce all terms and conditions of the grant. Kerr County agrees to fully cooperate in the monitoring process. III. RECORDS Requirements of the Uniform Grant and Contract Management Standards (UGCMS) promulgated pursuant to Section 783 of the Government Code are adopted by reference as part of this contract, including the contract provision as in Section 36, Common Rule of OMB, of the above standards. The Office of Court Administration, as Grantee Agency, shall keep all project records. Records shall be retained for at least three (3) years following the closure of the most recent audit report and until any outstanding litigation, audit or claim has been resolved. Records are subject to inspection by the Office of the Governor, Criminal Justice Division ("CJD'~, or any state or federal agency authorized to inspect the same. STATEMENT OF SERVICES TO BE PERFORMED: To promote the efficiency and effectiveness of the administrative functions performed for the Sixth Administrative Judicial Region, Kerr County agrees to provide an employee or employees for the Sixth Administrative Judicial Region. The State of Texas, through the Office of Court Administration, will provide certain funds for payment of salary expenses for an administrative assistant or assistants to the Presiding Judge of the Sixth Administrative Judicial Region. The administrative assistant or assistants will be employees of Kerr County, with the same rights and benefits now enjoyed or hereafter granted to employees of Kerr County and the same responsibilities of said employees. The administrative assistant or assistants shall be chosen by, and serve at the will of, the Presiding Judge of the Sixth Administrative Judicial Region. The duties performed by an administrative assistant include assisting with the assignment and coordination of visiting judges' schedules, maintaining records for judicial assignments within the region, preparing claims for the judicial assignments within the region, preparing claims for the visiting judges, and such other duties as maybe necessary for the efficient administration of justice in the Administrative Judicial Region. V. BASIS FOR CALCULATING REIMBURSABLE COSTS: Payment for the above described services (not to exceed $20,892.00) will be made as follows: The Office of Court Administration agrees to reimburse Kerr County for the period September 1, 1998, through August 31,1999, for the salary and related benefits of the administrative assistant or assistants for the Sixth Administrative Judicial Region, payable in twelve (12) monthly installments. Reimbursable costs shall include the actual salary payments to the designated administrative assistant or assistants to the Presiding Judge plus fringe benefits. Reimbursements will be contingent upon receipt of a signed statement from an authorized county official listing the salary and fringe benefits amount to be incurred by the county for the administrative assistant or assistants to the Presiding Judge. Any change in the amounts to be incurred by the county during the period of this contract shall be communicated in writing to the Office of Court Administration within thirty (30) days thereof. Billing for the above described services will be provided in the same manner as it would be provided to institutional purchasers in the absence of a grant and shall consist of a brief statement of the service or other item provided and the basis for the billing rate. VI. DEFAULT In the event of a default of Kerr County, the Office of Court Administration, may cancel or suspend this contract and Ken• County shall be entitled to recover for all services provided prior to the cancellation date or shall repay any funds for services not yet rendered. 2 VII. LICENSES, CERTIFICATIONS, AND INSPECTIONS All licenses, legal certifications, or inspections required for the services, facilities, equipment, or materials, and all applicable state and federal laws and local ordinances must be complied with by Ken County. Failure to comply with this requirement shall be treated as a default. VIIL TERMINATION OF CONTRACT This contract shall begin on September 1, 1998, and shall automatically terminate on the grant expiration date or any extension date thereof granted by CJD or upon termination of the underlying grant by CJD, provided that, if a successor Presiding Judge is appointed during the period of this contract who resides in a county other than Kerr County and offices of the Sixth Administrative Judicial Region aze removed to a county other than Ken• County, then this contract shall expire upon the actual date of removal of the Sixth Administrative Judicial Region offices to a county other than Ken County. All services billed hereunder must be rendered within the grant period.
