1. It is a violation of Kerr County Sight Distance Policy (Order # 22974) for a property
owner to permit an obstruction of sight distance caused by vegetation... if the
obstruction constitutes a tniffic hazard.
2. There have been five accidents at this intersection in the past four years. In the
accident report of 10/25/98, Driver # 1 on Loyal Valley "did not see Unit 2
Westbound on Ranchero I;oad".
3. This intersection being is a school zone makes it more important to have a safe
intersection with proper sight distance.
4. I recommend the Commissioners Court give NOTICE to the owner. Mr. Witliam
Ulmer, per section 4.01 of the Sight Distance Policy.

APPROVAL OF SIGHT DISTANGE POLICY
On this the 23rd day of October 1995, upon motion made by
Commissioner Lehman, seconded by Commissioner Lackey, the
Court unanimously approved by a vote of 3,-0-@, to adopt the
sight distance policy as submitted to the Court.
REGULATION OF SIGHT DISTANCES ALONG COUNTY ROADS
Pursuant to the authority provided in Tex. Rev. Civ. Stat.
Ann. ar•t. 67@2-1, Subchapter F (Vernon Supp. 1995), the Kerr
County Commissioners' Court hereby adopts the following Order
regulating sight distances along Kerr County Roads, such
regulation to be effective , 1995.

I.
DEFINITIONS
s used herein, "sight distance" Weans the unimpaired
a motorist at or near the intersection of a road with
road, an alley, a driveway, or another- way intended
by vehicular traffic.
1.@2 As used her^einy "prohibited obstruction" means any
obstruction of sight distance caused by vegetation or• loose
earth or^ any item other' than a building or other man made
structur^e affixed to the ground, if the obstruction
constitutes a tr^affic hazar^d.
II.
ADDF'TION OF SIGHT DISTANCE REGULATIONS
~.@1 The Kerr^ County Commissioners' Court hereby adopts the
sight distance r^estrictions for all county roads in Kerr
County, as set out in the attached diagram, entitled "Sight
Restrictions," attached hereto as Exhibit A, and such Exhibit
is hereby incor'por'ated by reference as if fully set forth
herein, and is made a part hereof for all purposes.
III.
PROHIBITION OF OBSTRUCTION OF SIGHT DISTANCES
3.@1 It is a "violation of this Order for a property owner to
permit a pr^ohibited obstruction of sight distance to exist or
remain on any property within Kerr County.
IV.
NOTICE OF OWNER
,.. 4.@1 If the Kerr^ County Commissioners' Court determines that
prohibited sight distance obstruction exists in violation of
this Or-der^, the Court shall give written notice of same of the
r^ecor^d owner- of the property on which the property is located.
~ 4.02 Such written notice shall be sent by registered mail,
return r^eceipt r^equested, to the record owner of the property,
and such notice shall include the following:
• (a) a description of the obstruction and of the
location of the obstruction;
(b> an Order- r^equir^ing that the owner- take specified
measures to correct the obstruction;
(c) a time limit, not less than 14 days, within which
the owner must complete the specified measures;
and
(d) a clear statement of the process available to a
property owner- who wishes to object to the removal
of the obstr-action, including time limits for^
requesting a hear^ing and the penalties for
non-compliance with an Or•der^ from the
Commissioners' Court

V.
HEARING
5.01 A property owner may r^equest a hearing to contest, or
seek clarification or• modification of an Order issued
pursuant to Paragraph 4.02. Such hear^ing request must be made
in wr^iting, and must be delivered to the Kerr County
Commissioner^s' Court on or befar^e the expiration of ten (10)
days after the date upon which the land owner received notice
of the existence of a pr^ohibited obstr-action.
5. ~c~2 If the pr^oper^ty owner- r^equests a hearing on an Order
issued pax^suant to Section 4.02, above, the Kerr County
Commissioners' Co+_irt`shall hold a hearing not later than the
tenth (10th) day after- the date upon which the r^equest for^
hearing is received.
5. Z~3 After- the conclusion of the hear^ing, the Kerr^ County
Commissioners' Cour^t shall make such written Or^ders as it
finds to be appr^opr^iate under the circumstances.
VI.
REMOVAL OF OPSTRlJCTION AND ASSESSMENT OF COSTS
6.01 If the owner- does not comply with the written Order
issued by the F<er^r^ County Commissioners' Court within the time
limits set by Such Or-der^, the Cotert may, after notice and the
expir^ation of the time per^mitted for a hear^ing request,
r^emove, dispose of, or^ cor^r^ect the abstr^uction and assess the
costs inc+_+r^r^ed by the County in removing, disposing of, or
cor^r^ecting the.obstr-action against the owner- of the pr^oper^ty
upon which the obstr-action was located,
6. 0c If the person asselased costs under- this section does not
pay the costs within sixty (6rn.) days after- the date of
assessment, a lien in favor- of the co+_mty attaches to the
proper^ty fr^om which the obstr^~_~ction was r^emaved or corrected
to recur^e the payment of the costs and interest accr^+aing at an
annual r-ate of ten per-cent (1@'/.) on any +_inpaid par^t of the
costs.

PENALTY
7.@1 In addition to the civil recovery of costs provided for
above, any violation of an Order to remove a prohibited
obstruction is a Class C misdemeanor, punishable by a fine of
up to S~@@.@@ pet- violation.
7.@~ Each day that an obstruction continues to exist in
violation of an Order to remove a prohibited obstruction
constitutes a separate violation for- purposes of criminal
prosecution.
VIII.
PAYMENT FOR L05S OF VALUE
B.@1 If the Kerr County Cammissioners+ Court removes or
requires a property owner to remove an obstruction under this
regulation, the Cour-t must pay the Owner an amount sufficient
to cover the loss of the value of the obstruction, as proved
by competent evidence.
8.@2 If the Ker^r County Commissioners+ Court incurs costs
in removing said obstruction, the value due to owner for- loss
of the value of the obstr^uction, if any may be subtracted from
the amount due from the owner to Kerr County for the Countyrs
costs of r-emoval.
IX.
r`' SAVINGS PROVISION
9.~Dc In the event that the provisions of this Order conflict
with an ordinance oft any municipality located in Ker-r County,
or with any r^ule of a state agency relating to billboards or
advertising, then such other ar^dinance or- rule or provision
shall take precedence over^ this Order^, and this Or^der shall be
of no force or- effect with respect to sight distance
obstructions contr-olled by such ordinances or rules.
