Judge Denson, seconded by Commissioner Leta, the Court
approved by a vote of 4-1-0, with Commissioner Lackey
opposing, the Water Truck to be returned to Road and Bridge ygrd
and put under control of Road and Bridge Administrator.

Subject: Consider use of Road & Bridge vehicles by someone other than a department
employee.
The Road & Bridge water truck that is kept in Center Point was damaged while
being driven by a volunteer fireperson. Center Point Volunteer Fire Department
has agreed to pay for the parts used in the repairs, however, when this happened it
brought up several questions that we feel need to be addressed.
1. Our employees must have a CDL to drive this truck. Do volunteer firepersons
who drive this truck need a CDL? When we called the Texas Department of
Public Safety, they said that it is not a fire truck and does not qualify for an
exemption and therefore the drivers must have a CDL.
2. Who is responsible if there is an accident? It is insured by the County on the
Road & Bridge inventory. It is not insured by the Center Point Volunteer Fire
Department.
3. There is a Center Point Volunteer Fire Department Logo on the side of the
truck as well as the Road & Bridge Logo.
4. Road & Bridge has a similiar truck that is usually kept at the Spur 100 yard, but
at this time it is not operational because we are having a hard time getting parts.
If there is a fire call to Road & Bridge, this is the truck the department uses to
respond. These trucks are also used for road work. Do we need to move the
Center Point truck to Spur 100 and have it accessable for use by the
department?
5. We have been told there was a Court Order to keep the truck in question in
Center Point allowing it to be used by the Volunteer Fire Department. We
checked with the County Clerk's office and the attached order is the only one
they could find that reference this truck.
