Boz 12060 Austin, Tezas 7 87 1 1-2060 ~ ~ Secretary of State Office of the Secretary of State MEMORANDUM TO: County Clerks/Elections Administrators FROM: Ann McGeehan, Deputy Assistant Secretary of State ~-_____ / ~' DATE: October 28, 1998 RE: Statement of Canvass Pursuant to section 67.007 of the Texas Election Code, the County Clerk/Elections Administrator must certify the county returns as canvassed by the commissioners court and deliver those returns to the Secretary of State not later than 24 hours after the completion of the canvass. Enclosed are two prescribed forms for the statement of canvass. One form is to be returned in the enclosed envelope labeled "Election Returns for County, for General Election, 1998." The other copy of the form is to be filed in your office. Also enclosed is a separate statement of canvass for the Governor and Lt. Governor's races (2 copies enclosed). Section 67.008 of the Election Code requires the County Clerk/Elections Administrator to prepare a separate return for these races. Return this statement of canvass in the envelope labeled "Returns of Election for Governor & Lieutenant Governor, County, for the General Election, 1998. The separate return for Governor/Lieutenant Governor is also required to be delivered to the Secretary of State within 24 hours after the completion of the canvass by the commissioners court. One copy of this statement is required to be filed in your office. Please be advised that section 67.003 of the Election Code states that the commissioners court must canvass the returns on November 10, 1998. This is a new law and requires the court to canvass on the seventh day after the election. Only two members of the commissioners court are required to be present to canvass the returns. Section 86.007 of the Election Code requires you to reconvene the early voting ballot board to count any ballots that were timely placed in delivery by 7:00 p.m. on election day from outside the United States and that arrive in your office by Sunday, November 8, 1998. Although this deadline falls on a weekend, it is not a deadline that moves forward to the next business day_. These votes must be included in the official canvass by the court. Please note that the entry for November 9, 1998 in the November election calendar published earlier this year incorrectly states that these overseas ballots may be received through Monday, November 9th.
