(c) Set Date for Public Hearing (Apri127, 1998) 1. Robert A. Wheeler, owner of Tract 56, requested variance to notification by certified mail, return receipt requested. Local Government code, Sec. 232.009(c) states: (c) After the application is filed with the commissioners court, the court shall publish a notice of the application in a newspaper of general circulation in the county. The notice must include a statement of the time and place at which the court will meet to consider the application and to hear protests to the revision of the plat. The notice must be published at least three times during the period that begins on the 30th day and ends on the seventh day before the date of the meeting. If all or part of the subdivided tract has been sold to nondevelgntr owners, flee raourt shall also give notice to each of those owners by certified w registered mail, return receipt - requested at the owner's address in the subdivided tract. I think the statute is clear and the variance should not be granted. Mr. Wheeler was advised of this statute. Saving money by the subdivider is not a reason to grant a variance (Kerr County Subdivision Regulation, See 5.04). 2. Lots 56-A and 56-B have less than 200' Frontage on Mustang Trail. 3. Lot 56 has approximately 100' difference in elevation from West corner to East comer, recommend drainage analysis of the effect of development on this lot on property below this lot.
