He will be familiar with the plans and specifications and will be able to visit and familiarize himself with the existing conditions, the contractor, and your architect. My fees will be based on $25.00/hour on an average of 20 hours per week for the duration of the courthouse remodeling project. Typing services will also be included at the $25.00/hour rate. The consultant shall be reimbursed for any long distance telephone calls, cost of photographs and other miscellaneous items, at their actual cost. A monthly statement will be submitted to the Commissioners Court for payment of the consulting services. In general, the consulting services shall consist of working with Mike Walker, the architect, his consulting engineers, the general contractor, and any other prime contractor working on the courthouse project. I will be watching to see that all safety measures are taken and observed by the contractor as nearly as possible to the OSHA regulations. Coordination of the contractors' work with present activities and functions of the courthouse will also be observed and reported as may be necessary. .~ Complete familiarization with the construction documents will be assured so that they are followed as interpreted by the architect and his consultants. Change orders will be presented to the commissioners when necessary by the consultant, when received from and approved by the architect. Application and certification of monthly payments to the contractors will be reviewed by the consultant. A weekly written report of construction progress will be presented to the commissioners by the consultant. Dated photographs of the construction progress will be submitted monthly. Compliance with any governing codes or State of Texas requirements will remain the responsibility of the architect and the contractor. The consultant will attend all construction meetings held by the contractors, and if necessary, will call for such meetings to solve any construction problems which may arise. The consultant will participate in a final "punch list" of items to ensure the courthouse project has been completed in a timely and professional manner. Additional services which become necessary may be added to this proposal by the Commissioners. Services of R. Keith Longnecker as consultant will begin immediately upon the acceptance of this proposal, which becomes an agreement for construction consultant services. This agreement maybe terminated by either party at any time during the construction of this courthouse remodeling project. ccepted by: R. Keith Longnecker, "Consultant", was hired as construction consultant to oversee Phase III Courthouse Renovation at a rate of $25.00 per hour based on an average of 20 hours work per week for the term set forth herein. Consultant will serve as the representative of the Commissioners' Court on all matters related to the day to day construction activities and will have the authority to make decisions on such construction and/or interpretation matters as they develop except Consultant will not have the authority to authorize any change order or modification that would require expenditure of any additional funds. If the Consultant does not agree with the architect or construction contractor on any matter related to the courthouse construction, such matter will be brought to the Commissioners' Court by the Consultant for resolution. Consuhant will: A. Be reimbursed for any long distance telephone calls, cost of photographs and other miscellaneous items, at their actual cost. B. Submit a monthly statement to Commissioners' Court for payment of consulting services. C. Be reimbursed for typing services at the Consultant's actual cost, not to exceed $10.00 per hour. N. Oversee compliance with any governing codes or State of Texas requirements by the architect and the contractor. O. Perform any additional services which become necessary may be added to this agreement by the Commissioners' Court. This Agreement may be terminated by either party at any time during the construction of this courthouse renovation project upon thirty (30) days written notice to the other party. This Agreement ends upon designation as "Final Completion" by Commissioners' Court unless extended by Commissioners' Court.
