The breakdown for January includes service for revisions which were made necessary by after- bidding revisions initiated by the District Courts officials, the Texas Department of Licensing and Regula- tion ADA/TAS, and Texas Historical Commission. Also please fmd a plan of the second floor which par- tially highlights where the changes are mandated by color-key legend by agency involved. Note that all decisions are not finally resolved; therefore, we are estimating based on several unresolved issues. Without extensive detailing of each, which I can enumerate for the Court, note that we are charging for a portion of the time expended for which we are entitled to invoice per our Agreement. When revisions were initiated, Construction Documents were finished, to the best of otu knowledge generally acceptable to each of the three entities, and the bidding in progress or completely bid prior to notification that there were problems. Some, including a few onerous and unreasonable requirements of TDLR may require extensive appeals process, which can not be construed as part of our Basic Services (e.g., the County can just acquiesce and furnish 2 toilets on the second floor of the Courthouse, where we had indicated 5, in- cluding one men's and one women's accessible). The service to assist the County to secure consultants and contractors to remove hazardous materials is specifically excluded in our contract. Per our standard AIA Agreement, we are not to have involvement with such materials. However, work needed to proceed, if we were to maintain an already lagging sched- ule, due to holidays and court turnover. Assistance in providing professional expertise for selecting an Owner's representative speaks for itself. Neither are include in the 54,500.00 estimate. Please note on the attached February 2 Invoice that we have a surplus of 511,000 plus, which is the differ- ence on our Guaranteed Maximum Fee based on a percentage of Construction Costs and what we are charging hourly, cumulatively. This savings to the County would be greater, but for revisions (and mostly improvements) made during Construction Documents Phase. We are pleased to tune our services and doc- uments to make the project better, as tong as that is balanced against increased cost in fees and construc- tion. We request approval of 54,500.00+52.00+1,062.00=$5,614.00 as Additional Fees, as provided in our Agreement. We would preserve the '`savings" difference in Basic Fees for the Construction Phase in case there are problems and we need that cushion. Otherwise, it is the County's to save.
