E5791 AF~PROVE AND ADORT RESOLUTION URGING ESTABLISHMENT OF A TIMELINE TO RROVIDE WASTEWATER TREATMENT IN UNSEWERED AREAS OF KERR COUNTY On this the Hth day of March 1995, upon motion made by Commissioner- Williams, seconded by Commissioner Letz, the Court unaniaously approved by a vote of 4-0-0, adopting the resolution that urges establishment of a timeline, as amended. STATE OF TEXAS COUNTY OF KERR RESOLUTION WHEREAS, areas of Kerr County, each with significant population density, do not have area-wide wastewater collection and treatment facilities, and in each of these areas failing septic systems pose a significant threat to public health and an ever constant danger to Kert County's surface and undergound water supplies; and WHEREAS, Paragaph ES 4.0 of the Regional Water and Wastewater Planning Study for Kert County, prepared for City of Kerrville, Kerrville Public Utility Board, and Upper Guadalupe River Authority state in part, "the soils and terrein of Kerr County are generally not suitable for effective septic tank operation or land disposal systems, therefore to prevent surface and goundwater contamination, wastewater should be collected and treated..."; and WHEREAS, Headwaters Undergoand Water Conservation District has often expressed concern for this condition to remain unabated and has used its gad offices to call public attention to this matter through public forums; and WHEREAS, Kerr County, City of Kerrville, Upper Guadalupe River Authority, City of Center point, City of Ingram, private water companies and interested citizens participated in these fad-gathering mectings; and WHEREAS, subsequently City of Kerrville in Resolution 99-118, enacted January 26, 1999, states in part it "stands ready and willing to consider requests from arty political subdivision or special district seated under the laws and/or constitution of the State of Texas with Athority to provide wastewater collection services in Kerr County to negotiate an agreement to provide wastewater treatment services to said political subdivision or district..:'; and WHEREAS, Upper Guadalupe River Authority in its 24/48 month plan has stated it will serve areas of Kerr County not presently served with wastewater facilities/services. NOW, THEREFORE BE IT RESOLVED, that Kerr County Commissioners' Court urges City of Kerrville to receive, review and act upon in a timely manner all requests for wastewater treatment brought forth by other governmental entities; and BE IT FURTHER RESOLVED, That Kerr County Commissioners' Court urges the City of Kerrville and Upper Guadalupe River Authority to develop a reasonable timetable for implementation of plans to provide wastewater collection and treatment facilitieslservices to rmsewered areas of Kerr County outside the corporate limits of City of Kerrville; and BE TT FURTHER RESOLVED, When City of Kerrville determines its current wastewater treatment facilities cart no longer support the demand for treatment service from outside its jurisdiction, and should City of Kerrville determine it has no interest in expanding its current wastewater treatment facility, then Kerr County Commissioners' Court urges City of Kerrville to support Upper Guadalupe River Authority or any other entity in permitting and wnstruding additional wastewater treatment facilities for the benefit of the citizens of Kert County.
