The Kerr Count Commissioners' Court recognizes that it is the inalienable right of each and every citizen to participate in their government and/or petition their elected or appointed representatives. The Commissioners' Court, however, realizes that the position or views of Kerr County as a political entity must be approved in advance by the Commissioners' Court. Therefore, to guarantee the rights of all citizens to participate fully in their government while protecting the position of Kerr County as a political entity, the Kerr County Commissioners' Court adopts the following policy regarding testimony by employees of Kerr County before the Texas Legislature, the United States Congress, committees of the Texas legislature or the U.S. Congress, or agencies or departments of the State of Texas or the United States of America: 1. Any employee of Kerr County, including elected officials, may testify on behalf of Ken County only after receiving the prior approval of the Commissioners' Court for the substance of such testimony, including any written submission. 2. Elected Officials may testify in their official capacity or on behalf of the trade organization to which they belong because of their official position; such elected officials are requested to provide copies of any written submission to the Commissioners' Court. 3. Kerr County employees that are not elected officials may testify only on behalf of their departments and only with the prior written consent of the elected official responsible for that employee. Reimbursement for the expenses of such employee on testifying will be taken from the department's travel budget. Copies of any written submission will be provided to the Commissioners' Court. 4. Any employee of Kerr County wishing to testify other than as provided herein may take vacation and do so at their own expense. Such employee shall state at the beginning of such testimony and in any written submission that the employee is testifying on his or her own capacity and not on behalf of Kerr County or the department in which such employee works. 5. Any exceptions to this policy must be approved in advance by a majority vote of the Commissioners' Court.
