RE: Official Designations Associated with Kerr County OSSF Program
Dear Judge Henneke and Member of the Court:
In reference to our discussion in your office on February 22, 1999, we
offer the following for your use and disposal.
The provisions for the establishment of the Authorized Agent by TNRCC
(Ken County) and the designation of certain individuals as Designated
Representative (R C. Wiedenfeld, proposed) are found in the Heahh and Safety
Codes of Texas and more specifically in Chapter 366, Sanitation and
Environmental Quality.
The more specific references are found in:
a) Subchapter A, General Provision, 366.002 definitions
1. Authorized Agent
4. Designated Representative
b) Subchapter B, General Powers and Duties of Department and
Authorized Agents.
c) Section 366.014, Designated Representative, all subsections
d) 30 Texas Administrative Code, Chapter 285, On-Site-Sewage-
Facilities
* Subchapter B: Local Administration of OSSF Program
* Subchapter F: Registration, Certification or Designated
Representative
In addition to the OSSF Designated Representative appointment there is
also the Floodplain Administrator to be designated by the Court. Statute and
Federal Regulation regarding this designation can be found in:
1. Texas Water Code, Subchapter I, Flood Insurance, Subchapter 16,
more specifically Subchapter 16.312.
2. National Flood Insurance Program (NIFP), Section 59.22 (b) (1).

continuing education programs, and holds the appropriate certificates to be
designated as:
1. OSSF Designated Representative (attached).

State Association).
