RESOLUTION BE IT REMEMBERED at a meeting of Commissioners Co~_ir^t of Herr- County, Texas, held on the i^cth day of Apr-il 1999, on motion made by Jonathan Leta, Commissioner- of Pr^ecinct No. 3, and seconded by H. A. Paldwin, Commissioner Pr^ecinct No. 1, the following Resol~_ition was adopted: WHEREAS, Rur-scant to Senate Bill i (75th Leg.), the Texas Water- Development Poard has appointed r-egional gr-oups to develop plans to address long ter-m water- supply needs in Texas; and WHEREAS, the wor-k of those gr-oups is in progress and will serve as the fo~_indation for- a new state water' plan; and WHEREAS, Section 11.085(s) of the Texas Water Code provides that transfer-s of water- from one r-iver^ basin to another- are junior to rights held by people in the basin or^ or-igin, pr-oviding much needed pr^otection dur-ing times of dr-ought to ensur-e the water' supply needs of the basin of origin ar-e satisfied befvr-e tr-ansfer-r^ing water- to other areas; and WHEREAS, even as the wor-k of the regional water planning gr^oups is ~_inder-way, Senate Bill 143 and its companion House Pill, HBiE45, have been introduced to r-epeai Section 11.085(s) of the Water- Code, setting the stage to tr^ansfer^ water- fr^om one ar^ea of the state to another^, even in times of dr'ought and befvr^e the needs of the basin of or-igin have been met; and WHEREAS, r^ather^ than eliminating safeguar^ds that protect against transferring water from areas of the state which will be dependent on that water^ during times of drought, the Legislat~.ir^e should encour^age and r^equir^e ar^eas for^ecasting long-term water^ shor^tages to develop new water^ supplies to serve those regions. NOW THEREFORE BE IT RESOLVED that the Commissioners' Co~_ir^t of N.er^r^ County, Texas opposes passage of Senate Bill 143, its companion bill, House Bill 1645, or^ any other legislation that would eliminate pr^otect ions • like those found in Sec. 11.085(s) of the Texas Water^ Code, and calls upon members of the Legislature r^epr^esenting ~:er^r^ County to wor^k in opposition to passage of those bills. Baldwin, Commissioner Precinct No. 1, the following Resolution was adopted: WHEREAS, Pursuant to Senate Bill 1 (75`~ Leg.), the Texas Water Development Boazd has appointed regional groups to develop plans to address long term water supply needs in Texas; and WHEREAS, the work of those groups is in progress and will serve as the foundation for a new state water plan; and WHEREAS, Section 11.085(s) of the Texas Water Code provides that transfers of water from one river basin to another are junior to rights held by people in the basin or origin, providing much- needed protection during times of drought to ensure the water supply needs of the basin of origin aze satisfied before transferring water to other azeas; and WHEREAS, even as the work of the regional water planning groups is underway, Senate Bill 143 and its companion House Bill, HB1645, have been urtroduced to repeal Section 11.085(s) of the Water Code, setting the stage to transfer water from one azea of the state to another, even in times of drought and before the needs of the basin of origin have been met; and WHEREAS, rather than eliminating safeguazds that protect against transferring water from azeas of the state which will be dependent on that water during times of drought, the Legislature should encourage and require azeas forecasting long-term water shortages to develop new water supplies to serve those regions. NOW THEREFORE BE IT RESOLVED that the Commissioners Court of Kerr County, Texas opposes passage of Senate Bill 143, its companion bill, House Bill 1645, or any other legislation that would eliminate protections like those found in Sec. 11.085(s) of the Texas Water Code, and calls upon members of the Legislature representing Ken County to work in opposition to passage of those bills.
