Vista dills Drive is in Vist2~ Hills Subdivision, according to Plat Retards at Volume 5, page 5©, Plat Records of Kerr County, Texas. "dicta Hills Subdivision was Developed by Barney i~. Williams Jr. ,and Vista Hills Drive was constructed at his expense by Reichenau Brothers Construction Co. ,inc. in 1988. Construction was according to County road specifscations. Vista Hills Water System, approved by the Texas State Department of Health as a public utility, is located do Vista Nilis Drive. Since completion of construction in 19$8 the water pumps have been stolen two times. The System i$ secured by an eight foot high chain- link fence with a locked gate, and a meta! door on the pump house with a locked metal bar. A monitored security system is being installed, but a monitoring phone line will not be available for two months. Vista Hills Drive is being used for illegal dumping, requiring constant clean up. Barney K. Williams wishes to place a gate at Vista Hills Drive for further security and provide privacy for tt~e property owners. Responsibility of maintainence by property owners that border on Vista Hills Drive will be added to the recorded restrictions. One single family dwelling per lot. 1400 sq. ft. minimum, H & C living area. Two bathrooms Two car Garage -not open to street 75% masonry Other buildings to be of same architecture as residence All structures at least 25 ft. from property line All structures shall be primary construction - no mobiles or modulars All residences, buildings or structures shall be approved by the Architectural Committee before construction. Temporary structures are prohibited 2. All fencing shall be wood, masonry, or chain-link. 3. No lot may be subdivided. 4. No hunting or discharge of firearms is permitted. 5. No lot shall be used for: Illegal, immoral, or offensive purposes For business purposes of any kind Storage of trash, garbage, construction debris, or other refuse For storage of any vehicle unless in a closed structure, or in an area not visible to the public For storage of any kind other than construction material during construction. Complete construction within one year from beginning. 6. Sewage disposal constructed in compliance with U G R A regulations 7. Prohibited: Berns, dams, or any water impoundment structures Drilling of water wells Keeping of livestock of any kind Kennels 7. Continued -Prohibited Pets outside a fence or off a leash Off road vehicles off primary roads No excavation for selling of soil, gravel, or rock 8. Water hookup and payment of water bills will be the expense of the property owner. 9. Architectural Control Committee Developer and two appointed members will exercise power of control of restrictions. After 75% of the subdivision is sold the property owners may form a Property Owners Association and elect an Architectural Control Committee. June 2, 1999 Addendum to: Declaration of Restrictions And Covenants Vista Hills Subdivision 1. Vista Hills Drive and Williams Drive are dedicated private drives. 2. Maintainence of Vista Hills Drive shall be the responsibility of property owners of lots 7,8,13,14,15,16,17,18,19,20, and 21. 3. Maintainence of Williams Drive shall be the responsibly of property owners of lots 1, 2, 3, and 4. 4. The need for maintainence shall be determined by the Architectural Control Committee or The Property Owners Association. 5. Contract for maintainance shall be done by the Committee or the Association and the expense shared equally by the property owners of responsibility as of that date.
