It is owned by Mr. George L. Williams. Tract 47 is bounded by Buffalo Drive, a platted roadway of 40 foot width which has never been built and is barely noticeable on the ground. It was designed (on paper) to serve Tracts 46, 47, 48-A, 48-B and 48-C, all of which have a second roadway. Mountain Drive or East Buffalo Drive to serve them access. Buffalo Drive in reality, was never really needed and probably might explain why it was never built. East Buffalo Drive does presently exist and is a gravel and caliche all weather road serving Tract 49, 41, 42 and 47. Mr. Williams desires to subdivide Tract 47 into four parcels, keeping Tract 47-A thereof to himself and selling Tracts 47-B, 47-C, and 47-D. I have subdivided this tract in such a way that all three "sell-off' tracts front a minimum of 200 feet along East Buffalo Drive, the existing roadway. This proposal is an attempt to avoid the expense of building Buffalo Drive allowing the fact that it would not be necessary for tract access. The plat is also designed to give Kerr County an additional ten (10) feet of land adjacent to the existing forty (40) foot rights of way for future road purposes; the metes and bounds conveyance would describe a thirty (30) foot wide strip from Mr. Williams to the existing centerlines of Buffalo Drive and East Buffalo Drive. Mr. Williams also owns Lot 6 of Mountain Ridge Estates. He purchased this tract because it adjoins the portion of Tract 47 his is going to retain and to drive across it as driveway access from Mountain Ridge Spur to his hilltop site. Even ff Buffalo Drive was installed (built), the terrain is forbidding to get to the hilltop site. In Mr. Williams deed to Lot 6, there is a clause, granting if you will, of a perpetual right of access across Lot 6 for access to Tract 47; I've enclosed a copy of that deed. Please review this plat and circumstances for recording purposes and let me know your comments. I have in addition, the following questions: 1) Due to the common ownership of Lot 6 with Tract 47-A, can Tract 47-A serve as access from Mountain Ridge Spur as long as Mr. Williams retains ownership of Lot 6? 2) If Mr. Williams, in the future, wishes to sell the unused portion of Lot 6 he doesn't drive across, would he have to do a replat of just Lot 6, or would it have to be a replat of Mountain Ridge Estates involving that developer? 3) Due to the new tract frontages along East Buffalo Drive, can improvements to Buffalo Drive be avoided? 4) Being that East Buffalo Drive is currently in place and used in it's current condition, does it have to be rebuilt to county specs; and if so, because a new paved road is to be placed that would benefit existing adjoining property owners, do they share in the expense or does the burden rest entirely with the developer Mr. Williams. 5) If East Buffalo Drive will need to be rebuilt, will this also include building outward (northeast) to where it intersects Mountain Drive and inward (southwest) past the end of Tract 47 to the terminus of E. Buffalo Dr.; or would the rebuild only be along the Tract 47 frontage? 6) What would the Commissioner's Court agenda be for this plat be if it happens to be in an acceptable form at this point?
