Reference the memo from the Roads & Bridges department, dated July 26, 1999 The referenced memo raises several concerns, particularly the situation outlined in paragraph 1. Involving Hurt-Prior Road. I would like to discuss having the County Attorney's office send letters to the landowners involved reminding them of the public's right of access to public roads and the possible legal consequences of accosting law abiding citizens (including TxDOT crews doing their job) on public road right of ways. I would also like to discuss landowners' rights in posting "No Trespassing" signs on public road right of ways. Leonard Odom, Jr. County Engineer Road Administrator TO: Commissioners ourt FROM: Truby Hazdi DATE: July 26, 1999 RE: Road Survey by Texas Department of Transportation This past week the TxDOT came back to Kerr County to do corrections on the road survey. On the first day they incurred the following problems: 1. Hurt-Prior, Pct. 4. ARer they went the length of the road and were leaving Dwight Smith (ranch overseer) blocked their exit with his truck and verbally assaulted them. They did give us credit for the distance of this road, but they attached a permanent note to that road to never return to the road. 2. Littlefield, Pct. 4 There was a "No Trespassing" sign posted facing traffic'/z way down this road and they can not go beyond a "No Trespassing" sign. If it is removed they will correct the mileage next yeaz. Wilson Ranch Road, Pct.4 (Behind MO Ranch) There was a locked gate. No county maintained road is to have a locked gate. After the first day of the survey, they called to tell us they were working in the area and told us about the problems listed above. I furnished them with a camera and asked them to take pictures of any problem areas. I also told them if they found any improper "No Trespassing" signs we would see that they were removed or properly placed. The foreman at each of these locations is going to visit with the landowner and correct these signs. TxDOT will submit a corrected mileage to the County Judge and to the State Treasurer for Lateral Road Funding. They will return every year to make corrections, additions, or deletions.
