SUBJECT: Request for increase in Civil Fees
Due to an increase in requests for service of Writs and the time required and spent on
such, I am requesting that the Commissioner's Court increase these fees effective January
1, 2000, which must be done at budget time.
According to the Sheriffs' and Constables' Fees published by the Comptroller of Public
Accounts, effective January 1, 1999, there are 12 counties that chazge over $100.00 for
Writs, the maximum being $200.00. I do not feel that $200.00 is an unreasonable amount
to request. Kerr County currently charges $100.00 for Executions, Writ of Executions
and Order of Sale (Tax Warrants). Writs of Attachment, Garnishment, Sequestration and
Possession require as much, or more time, and we only chazge $45.00 for service of each.
Also there are approximately 179 counties whose fees for service of Subpoenas, Citations
and Summons range from $50.00 to $75.00. Kerr County's fees are $45.00.
