Summaries of Discussions with Private Industries No Other Entities Provide A Similar or Related Service The Kerr County Solid Waste Enforcement Officer currently attempts to enforce litter laws and respond to illegal dumping complaints. The proposed project will allow the only Solid Waste Enforcement Officer in Kerr County to dedicate all of his time to cleaning up the rural and sub- standard subdivision. Form 6. Project Summary Form 6a. Project Description Why the Proposed Project is Needed: Kerr County is a predominantly rural community which is experiencing rapid growth. The Guadalupe River and its tributaries are located in the County, and solid waste in or near the flood plain constitutes potential pollution for both surface and underground water. Citations are seldom issued for illegal dumping, and in those few cases where they are issued essentially no prosecution has occurred. Most often code enforcement occurs as a byproduct of the County's septic system permitting process that includes the on-site inspection of construction projects. Some Kerr County subdivisions were platted 50 years ago and today consist of numerous lots held by absentee owners and littered with abandoned junk vehicles, bed springs, household appliances, trash and other health hazards. The unsightly appearance of these lots, often in direct view of highways, encourages others to illegally dump their waste. Goals of the Project: 1. To enhance a solid waste enforcement office that will serve all citizens of Kerr County both by enforcing laws against dumping and causing the removal of solid waste illegally dumped in the County. 2. To conduct surveillance of dumping locations and to apprehend violators. 3. To initiate an educational program, reducing the incidence of solid waste dumping. 4. To reduce the amount of solid waste illegally dumped in Kerr County and to increase citizen awareness of the proper methods of disposal. Who Will Benefit: A1142,623 citizens of Kerr County (1997 estimate by the U. S. Bureau of the Census) will be served by this project. Geographical Area of Project: The geographical area of this project will be the 1,107 square miles of Kerr County. Specific Waste Stream Targeted: The targeted waste stream will include such item as junk automobiles, household appliances, and any other solid waste illegally dumped in Kerr County. Public Education /Public Input: The educational materials include in this grant request will be used to educate the public about solid waste laws and proper method of disposal. Kerr County, through its Solid Waste Officer, currently has in place a system by which citizen complaints are logged, acted upon, and tracked. The Enforcement Officer position will allow even greater responsiveness by the County to citizen concerns. Feasibility /Workability of Project: 1. Kerr County has hired apart-time Enforcement Officer who will work under the existing Kerr County Solid Waste Officer. The Enforcement Officer is a certified by the Texas Commission of Law Enforcement Standards and Education with at least a basic certificate and be familiar with the Texas Penal Code. 2. Kerr County has purchased for the Enforcement Officer necessary support items, including a vehicle equipped with radio, a digital camera for evidence gathering, a global positioning receiver for accuracy of location, etc. 3. The Enforcement Officer will attend educational classes at TNRCC and the Texas Department of Health relative to enforcement. 4. The Enforcement Officer will hold workshops with the Kerr County Commissioners' Court and the Kerr County Attorney regarding solid waste laws. 5. The Enforcement Officer will work with the Kerr County Commissioners' Court and the Kerr County Attorney to adopt required sections of the Health and Safety Code with regard to solid waste abatement and enforcement. 6. The Enforcement Officer will work with the Upper Guadalupe River Authority to enhance data on pollution of waste sources. 7. The Enforcement Officer will prepaze educational information and present programs at schools, civic clubs, churches, and prepare and release information to the news media. 8. The Enforcement Officer will educate County Law Enforcement Officers to provide additional manpower for solid waste violation identification. 9. The Enforcement Officer will respond to all complaints within the County regarding solid waste. 10. The Enforcement Officer will prepare forms (Notice of Violation) to send to property owners. The computer system to be used will utilize GPS information, and by interfacing with the Kerr County Appraisal District, will provide accurate information as to the owner of property where an illegal dump site is located. 11. The Enforcement Officer will compile a list of firms that will remove and/or purchase solid waste from property in Ken County and make the list available both to violators of solid waste laws and to the public. 12. Using GPS the Enforcement Officer will inventory existing, illegal solid waste locations, particularly identifying those in the flood plain. 13. The Enforcement Officer will follow up on notices and request that the Kerr County Attorney file charges in instances where property owners refuse to comply. 14. The Enforcement Officer will conduct surveillance of existing dump locations to apprehend and prosecute violators. Form 6b. Project Cost Evaluation Total Related Costs: Total costs to Kerr County have been considered. Kerr County will provide supervisory support (by the Kerr County Solid Waste Officer), office space, telephone, supplies, and clerical support as needed beyond the grant funding. Cost per Capital: $.84 per capita Similar Projects: Kerr County has no similar programs with which to compare costs. Cost Justified: It is anticipated that a sufficient number of vehicles and other solid waste (200 vehicles and/or between 20 and 50 tons of solid waste) will be identified for removal to allow feasibility of hauling them to a central location and having a recycler come to the area with a compactor. Any momentary proceeds of this effort will be put back into the program. Form 6c. Level of Commitment of the Application [n-Kind Services Kerr County is supplying in-kind services through supervisory support (by the Kerr County Solid Waste Officer), office space, telephone, supplies, and clerical support as needed beyond the grant funding. Salary: Kerr County is requesting funding for one half-time position for Code Enforcement and 8 hours a week for clerical support. Sustainability of Program: It is felt that the citizens and Kerr County Commissioners' Court consider the program to be successful, funding will be available through the County in the subsequent years. Formal Support: Attached are: Order No.26092 , a resolution of support for this project approved by the Ken County Commissioners' Court on October 25, 1999. Previous Commitment: Ken County currently funds a Kerr County Solid Waste Officer. It is through this office that the need for an Enforcement Officer has been brought to the attention of the Ken County Commissioners' Court. Past Performance: Ken County has received grant funding for this solid waste project from the AACOG this past year. IIowever, as a financial partner in the Community Recycling Center in Kerrville, Kerr County has demonstrated a commitment to regional solid waste management. 6d: Scope of Work Benefits will include both a healthier and more aesthetically pleasing environment including the protection of both surface and underground water.
