"BUSTER" BALDWIN, Commissioner Pct. 1 WILLIAM "BILL" WILLIAMS, Commissioner Pct. 2 24 LARRY GRIFFIN, Commissioner Pct. 4 25 ABSENT: JONATHAN LETZ, Commissioner Pct. 3 2 1 On Tuesday, September 5, 2000, at 1:30 p.m., a special 2 Commissioners Court meeting was held in the Commissioners' 3 Courtroom, Kerr County Courthouse, Kerrville, Texas, and the 4 following proceedings were had in open court: 5 P R O C E E D I N G S 6 JUDGE HENNEKE: Okay. It's 1:30 on Tuesday, 7 September the 5th, Year 2000. We'll call to order this 8 special Commissioners Court session. The item for 9 consideration today is consider and discuss Change Order 10 Number 4, Change Order Number 5 not being quite yet fully 11 complete, for renovation of Courthouse Annex. Keith? Do 12 you want to give us a real quick explanation of where we 13 are? 14 MR. LONGNECKER: Thanks for this meeting. 15 Keep this contractor working so he doesn't have a chance to 16 tell us we're delaying the work. We went over this 17 item-for-item on the 28th, last Commissioners Court meeting, 18 and all of the prices have been finalized. They've been 19 pretty well agreed on by the contractor, as well as myself 20 and the architect. It's been signed by both the architect 21 and the contractor, for a total increase in the contract of 22 $1,575. Did you want to go through the items quickly again? 23 JUDGE HENNEKE: Do any of the Commissioners 24 wish to go through the items further? 25 COMMISSIONER GRIFFIN: The one question -- 3 1 there's only one question I had. There was a question mark 2 on how much of a credit we got on one of them. 3 MR. LONGNECKER: Yes. 4 COMMISSIONER GRIFFIN: Did we get this 5 credit? 6 MR. LONGNECKER: Yes, we did. 7 COMMISSIONER GRIFFIN: Okay. Everybody was 8 happy with it? 9 MR. LONGNECKER: Item 14, to leave out a 10 window up here in the second floor back in this storeroom 11 area, that came -- that credit is for $3,050. We had 12 another credit of $868 for not putting in trim on the 13 basement windows on the lower level windows down here, 14 because that space is still unfinished, and until that is 15 decided, what the space is going to be used for and what the 16 finish will be, it's -- we'll just keep the material -- 17 we'll have the material, but there is a credit for the labor 18 and not putting that in. The rest of these items will give 19 the contractor a chance to complete everything needed. I 20 think there's still -- there may still be some sump pump 21 problems on the elevator -- the new elevator, itself. But, 22 the furring-in of some existing pipes that the Elevator Code 23 calls for, and the self-locking gate and the chain-link 24 fence around the machinery for the elevator, and -- there 25 was something else -- the conduit for the telephone in 4 1 there, that is all included in this, which will bring it to 2 the point where the elevator inspector can come and give us 3 a yea or nay on whether or not it's ready for public 4 service. Everything else is -- is here. 5 And I might mention that Directive 18 is out. 6 It's going to have to do with -- right now there's a little 7 controversy on who was to furnish the sump pump, whether it 8 was in the -- this is a pump for the pit of the elevator 9 that would be kind of an emergency thing, that would pump 10 out any oil leak. This is a hydraulic elevator, so if it 11 leaks, there has to be some way -- someplace for that oil to 12 go. There will be a 55-gallon drum in the machine area that 13 that is to be pumped into. And, somehow or other, they're 14 saying that the pump was not included in their contract, and 15 Mike Walker and the architect is saying it was. So, until 16 that's settled, I don't know. 17 Now, the other thing I might mention, we have 18 an allowance of $5,000 to provide electronics and controls 19 and openers for the sallyport doors, two new -- or one's an 20 existing at the east, and a new one on the west. And that 21 $5,000 was to cover those controls, plus refurbishing the 22 old elevator. Well, we've come up with a way to spend less 23 money on the old elevator, and I'm looking for a credit out 24 of that of, say, $1,200 to $1,500. So -- 25 JUDGE HENNEKE: Good. 5 1 COMMISSIONER GRIFFIN: We're getting pretty 2 close. 3 MR. LONGNECKER: -- we're beginning to 4 balance things out here more than -- and since the contract 5 is running between 85, 86 percent complete, which is what's 6 left, we'll finish this second floor in this building, I 7 don't see -- I don't anticipate any -- any large change 8 orders, 'cause that's such a small amount of work yet to do. 9 JUDGE HENNEKE: Our latest report indicates 10 you think we might actually be able to occupy the two new 11 courtrooms in the early to mid-October time frame? 12 MR. LONGNECKER: That's what we discussed in 13 our last -- last Thursday's construction meeting. 14 JUDGE HENNEKE: Is that going to be -- will 15 the City allow us to do that, in your opinion? 16 MR. LONGNECKER: That's including, yeah, 17 getting a -- a permanent Certificate of Occupancy for that 18 second floor. 19 JUDGE HENNEKE: Would you have any hesitation 20 to allowing us to go ahead and use that space while they're 21 under construction in the District Clerk's Office? 22 MR. LONGNECKER: We've discussed that with 23 the City Building Inspector -- I have, and he says that you 24 can work out a way that -- the only thing that the 25 contractor might want to use is access to the new elevator. 6 1 We're going to try -- he's going to try and stay out of that 2 as much as possible, 'cause that's -- that's going to be 3 cleaned up and used ready for the public at that time. 4 That's the main way to get up and down from -- to the second 5 floor, besides the stairway. But those will all be 6 finished. The -- the stair and the elevator and the fire 7 alarm system will all be up and running, and so there's no 8 reason that we can't occupy -- Mike Walker had completed his 9 punch list Saturday, so it's up to the contractor now to see 10 how soon he can complete those items that are on the punch 11 list. 12 COMMISSIONER BALDWIN: And we can -- we can 13 accept a partial -- acceptance? Accept that portion over 14 there? Actually, I'm going to direct the question up here. 15 We can accept that over there without accepting this? 16 Without the total project? We just accept part of it, and 17 then accept the rest of it later on? 18 MR. LONGNECKER: Yeah, that was the general 19 plan. 20 COMMISSIONER BALDWIN: I don't see any other 21 way around it. 22 MR. LONGNECKER: 'Cause it will be up -- 23 JUDGE HENNEKE: Everything's done. When 24 Keith and Mike are ready for to us do that, we'll bring it, 25 obviously, to the Court. 7 1 COMMISSIONER BALDWIN: Yeah. 2 MR. LONGNECKER: I mean, you have to take 3 your courtroom someplace up here. 4 COMMISSIONER BALDWIN: Yeah, I understand. 5 I'm just looking at -- what I'm wondering about is the 6 acceptance of just a portion of an overall project. If we 7 accept the project, are we accepting this up here before 8 it's even done? 9 COMMISSIONER GRIFFIN: No. Accepting the 10 phase -- we can accept it by phase. 11 MR. LONGNECKER: Accepting Phase 3-A. And we 12 have this in two phases, and 3-B is what we're going to do 13 on this side. 14 COMMISSIONER BALDWIN: Okay. 15 COMMISSIONER GRIFFIN: We need a motion, 16 right? 17 JUDGE HENNEKE: Yes, we do. 18 COMMISSIONER GRIFFIN: I'll make the motion 19 that we approve Change Order 4. 20 JUDGE HENNEKE: Yes. 21 COMMISSIONER GRIFFIN: In the amount of 22 $1,575? 23 MR. LONGNECKER: $1,575. 24 COMMISSIONER GRIFFIN: Right, $1,575. And 25 that we -- how do you -- 8 1 JUDGE HENNEKE: It's in the budget. 2 COMMISSIONER GRIFFIN: It's in the budget. 3 COMMISSIONER BALDWIN: Second. 4 COMMISSIONER GRIFFIN: That's my motion. 5 JUDGE HENNEKE: Moved by Commissioner 6 Griffin, seconded by Commissioner Baldwin, that the Court 7 approve Change Order Number 4 in the amount of $1,575. Any 8 further discussion? If not, all in favor, raise your right 9 hand. 10 (The motion carried by unanimous vote.) 11 JUDGE HENNEKE: All opposed, same sign. 12 (No response.) 13 JUDGE HENNEKE: Motion carries. 14 MR. LONGNECKER: I might add that this does 15 not add any more time extension on the contract. 16 COMMISSIONER WILLIAMS: Well, that's good 17 news. 18 COMMISSIONER GRIFFIN: Excellent news. 19 JUDGE HENNEKE: If there's nothing else, we 20 stand -- 21 MR. LONGNECKER: Do you have that copy I gave 22 you with the signed -- 23 JUDGE HENNEKE: Probably, somewhere. 24 MR. LONGNECKER: Well, if I can get a 25 signature on that, I can get it to the contractor.
