I want you to have an advance copy so you can see the information that causes me to have concern about the combined affect of the revisions to the OSSF rules and subdivision rules. The first portion of this data shows what the current and proposed State rules allow for lot size. Also included is what our new subdivision rules allow for fot size. We have made a pictorial interpretation of those rules for your review. Please let me know if our interpretation is incorrect. Next we show some existing subdivisions (Greenwood Forest, Oak Forest South, Woodridge and Kerrville South) with lots'/ acre or smaller. We show (and surveys we have performed in these subdivisions to give you a feel of the land area that remains once homes, driveways, patios and sidewalks have been installed. Our surveys do not show steep slopes, shrubs or trees, which could further Limit the usable area for on-site systems. Next I have the UGRA wafer quality data of the seeps adjacent to these subdivisions. As you can see many are elevated above surface water quality standards. These subdivisions were development in the 1970's and early 1980's. The on-site system of choice at that time was almost exclusively the conventional system. The on-site systems that serve these lots now are predominately conventional systems yet some have been upgraded and still others installed with new homes have more site appropriate systems. Lane and I do not want to recreate these same land development scenarios that have created some of our current water quality problems. Last is a recent article from a Waco newspaper discussing the clean up of a river on TRNCC's impaired water body list and the finger pointing that is resulting. This community and local industry is already feeling the squeeze by TNRCC to restore surtace water quality. Yours truly, ~Ur~ ~ ~ ~~~7`~ ~~s Texas Nataaral Resottrce Conservation Commission Chapter 2g5 - Oo-Site Sewage Facilities Page 6 (2) In the case of OSSFs proposed for installation, construction, aleetatiott, extension, repair, operation, and maimenance in azeas of the state void of an authorized agent, the executive director will be the permitting authority in accordattcc with this chapter. (b) Unauthorized systems. Boreholes, cesspools, and seepage pizs shall not be authorized foe installation and use in Texas. (c) Variances. Requests for variances from provisions of this chapter may be considered by the appropriate permitting authority on an individual basis. The variance request must demonstrate to the satisfaction of the permitting authority that the variance has been requested because conditions are such that the equivalent protection of the public health and the environment can be provided by alternate means. Any request for a variance under this subsection must contain planning materials prepazed and sealed by either a registered sanitarian or a registered professional engineer. (d) Exclusions. The following aze exclusions from provisions of this chapter at+d taawst be permitted under Chapter 26, Texas Water Code, and Chapter 305 of this title {relatsig m Consolidated Permits): (1) One or more systems of treatment devices and disposal facilities ~ cumulatively produce more than 5,000 gallons of sewage per day an one piece of property; {2) Any system that produces waste that is eMlter non-domestic municipal, recreaeional, agricu]tural, industrial, or other as defined in Chapter 26, Texas Water Code; and (3) Any system that will have surface discharges into waters in the state or discharges adjacem to waters in the state. >~55,4. Fat>~ty Plann®g- (a) Land platuting and site evaluation. Land developments and land subdivided for bttiklgtg construction which will utilize OSSFs for sewage disposal shall be evaluated for overall site suitability a~ this submittal shall be reviewed and approved by the permitting authority prior to approval being granted for subdivision of the property. The following items shall be evaluated: (1) Residential lot sizing. (A) General considerations. The failure of an OSSF may be caused by a lazge number of circtttnstances, including inadequate soil percolation, improper construction, planning, installation, and misuse. The single most imporGatt fac.or concerning public health pmblerns resuhmg from these failures is the residerttial dwelliaA density is prmtarily a function of lot size. The failure of an OSSF in a highly populated atra is the f>a~nemal cattle of public health hazazds txsulting from on-site sewage disposal. Failure of an OSSF provides a medium for the transmission of disease and the fact that many people aze in the vicinity causes concern over the spreading of disease. The failure of an absorption system on a small lot can be financially disastrous to the owner because the lot may not contain sufficient room to construct a new absorption field in a new location. (B) Platted or tmplatted subdivisions served by a public water supply. Subdivisions of single family dwellings platted or created after January 1, 1988, and served by a lots having surface areas of at ]east 'fz acre or shall have site-specific sewage disposal plan submitted _o by a registered professional engineer or registered sanitarian and approved by the permitting authority. e The location of an OSSF under this pazagraph shall be in accordance with §285.91(10) of this title (ielating to Tables). In no instance shall the azea available for such systems be less than two times the design azea. (C) Platted or unplatted subdivisions served by individual water systems. In subdivisions platted or created after January 1, 1988, for single family dwellings where cacti lot :ed maintains an individual water wpply well and.an OSSF, the sewage disposal plan shall show the approved well location aad a sanitary control easement around the well within a l0U-foot raditas tact which no arbatrfact sewage system may be constructed. A watertight sewage unit or lined ;ly evapotra~piration bed with leak detection capability maybe placed closer to the water well than 100 feet, provided the permitting authority has granted a variance. To mini,,,i~e the possibility of the transmission of waterborne diseases due to the pollution of the water supplied for domestic use, each lo[ ~~, in a subdivision shall contain no less area than one acre, or shall have site-specific planning materials prepared by a registered professional engineer or a registered sanitarian and approved by the permitting authority. (2) Manufacarred housing communities or multi-trait residential devebpmeads served by a central sewage collection system for on-site disposal. The Waco City Council fast week authorized spending $60,000 to hire the Thompson Group, an Austin-based public relations firm, for the next year The group has promised to develop and implement a "communications plan" that will educate Lhe public, the media and legislators on the North Bosque issue, from Waco's perspective. That will include developing media information packets and sending favorable news clippings to legislators. "Ithink we've always had the right message, but these folks are going to help us get if out.° In its proposal for the job, the Thompson Group warned that the water problem could get national media exposure because of President Bush's ranch in the watershed of lake Waco, and that could hurt Waco's reputation. "Bach aggressive actions would potentially serve to hurt the credibility and the public trust of Lake Waco's integrity as a drinking water source," the firm cautioned. "Rather, the city should frame this issue as one whose status is not yet critical, although it could be if action is not taken." The group said the city should cast the issue as a local one, "without turning the issue into a larger statewide referendum on agricultural issues." $owever, the Texas Farm Bureau is already considering the wider implications of the North Bosque struggle, said spokesman gene Hall. "What's going on here could ba- precedent-setting," he said. He acknowledged that the Farm Bureau has been polling Waco residents m the past few days but declined to discuss the poll in detail He said the agri- cultureadvocacy group is merely "fact-finding" and trying to find out what people think about the North Bosque issue Dairymen also meeting Meanwhile, the Coalition for Affordable Local Milk scheduled a meeting Monday in Dublin for dairymen to discuss the North Bosque dispute, according to . Flier advertising the meeting. "If you don't like Waco's hell cop[ers flying over your dairy. don't miss this meeting!" the flies urges. "We will discuss the outlook for the immediate future of the dairy industry in Central Texas. This meeting is of vital impottance!° The reference was to the city of Waco's airborne surveillance to find polluting dairies. The meetiag at the Cottonwooa5 Auction Barn was closed to the public and limited to dairy pro- ducers. According to the flier CALM is a joint effort of the Texas Association of Dairymen, Zia Milk Producers, Elite Milk Producers. Select Milk Producers and Dairy Farmers of America, one of the largest milk cooperatives in the country. Dairy Farmers of Arnerica officials deferred comment on the new coalition to the Texas Asso- ciation of Dairymen. James Terrell, spokesman for the dair- ymen's group, did not return phone calls Monday.
