Appointment of Jerry Phillips as Assistant County Attorney at an annual salary of $38,250.00; and b. Correction of erroneous reporting of Assistant County Attorney as a step/grade position Effective July 23, 2001, I employed Jerry Phillips as an Assistant County Attorney, an exempt position, at an annual salary of $38,250.00. At the time I filed the required "Notice of Employment Action and Verification Form" (Exhibit A) with the Treasurer's Office, I was notified that I would need to address the Commissioners' Court regarding the matter of the salary being exempt from the step/grade position schedule and regarding the setting of salary for the position at any point other than grade/step 25.1. This was the first I became aware there was a problem. As background, I submit the following for your review: 1. At my Budget Workshop on July 14, 2000 (Exhibit B), I reminded the court that my two assistant county attorneys are exempt and that the step/grade issue only applies to them as a "benchmark" figure for purposes of issuing paychecks (Exhibit C). (Please note that my two assistants had been inserted into the middle of a paygroup, 25, but could also have been inserted into paygroups 26, 24, or 23; as far as I can tell, the insertion point was arbitrary. They were hired at annual salaries of $37,500 and $35,000, which approximates 25.8 and 25.5, respectively, as well as 26.6 and 26.3, etc.) 2. When I received the print-out of my department's position schedule (Exhibit D), I had no reference point for comparison. However, in going back and comparing the previous year's position schedules for my department as well as other departments with this year's (excluding elected officials and department heads) I discovered that only my department's exempt positions had been altered to reflect step and grade (Exhibit E). Apparently this confusion arose during the Nash study, when he "converted certain positions to "grades" for benchmark purposes (Exhibit F), these being Court Reporter, Court Coordinator, Assistant Attorney, and Juvenile Probation Caseworker. However, please note that none of these other positions remained "converted on the position schedule printout (Exhibit E). 4. To further substantiate, Page 14 of the current Personnel Policy, 5.12(d) identifies an appointed position as "exempt, non-step/grade° (Exhibit G). 5. GENERAL STATEMENT OF DUTIES: This is a very responsible position. Duties include performing a variety of functions to prepare cases for prosecution; prosecuting cases in court; providing legal counsel to the county's commissioners' court and county department heads; and performing other legal functions as assigned. EXAMPLES OF WORK• Represents the citizens of Kerr County in the prosecution of civil, juvenile, criminal and probation cases before justice and county courts; Interviews witnesses, examines physical evidence and resolves questions of law in the preparation of cases; Represents the county in mental and alcohol commitments to the state hospital; Conducts pretrial hearings on motions submitted by defense counsel; Prosecutes cases of theft by check;
