PROCLAMATION WHEREAS; A flood is a natural and expected condition on the Guadalupe River; WHEREAS; A flood is likely to occur when very heavy rains fall for an extended length of time; WHEREAS; Slow rains that continue for many hours can also bring on floods; WHEREAS; Thunder, intense lightning, and black clouds aze flood warnings that nature provides; WHEREAS; At times of heavy rainfall, the Guadalupe River and adjacent creeks flow very full and fast, and a wall of water called a crest is sometimes created, causing a rise of several feet in a matter of minutes; WHEREAS; The River and creeks can then spread out of their banks to great widths and create severe destruction; and WHEREAS; Weather experts are predicting major hurricanes that cause some of the Kerr County floods. NOW THEREFORE BE IT KNOWN: That I, Fred L. On August I5, 2001, the UGRA Board of Directors adopted a resolution declaring November 26-3Q 2001 as Flood Awareness Week in Kerr County. The need for the awareness progam was presented to the UGRA Board by Madams Mary Virginia Holekamp and Rosa Lavendar. Ms. Holekamp has successfully promoted an educational progam for grades 3-5 in all school districts in Kerr County. UGRA's Public Education/Information Committee with UGRA Staff has prepared a teacher's lesson plan handbook consisting of games, tests, coloring pages and lecture material to be distributed to twenty (20) teachers throughout the county. Most of us take the Guadalupe River for granted and many of us are naive as to its powers to destroy property and to take lives during infrequent flooding events. UGRA respectfully requests that the Commissioners Court join in with the River Authority in promoting community awareness campaign by declaring November 26-30 as Flood Awareness Week in Kerr County. Should you need additional facts in preparation of a similar resolution, please contact Kathy Mitchell at UGRA, ugrakl~m_u~i~ra.c~rr* or 896-5445 Enclosure-1 Resolution No. 2001-09 Cc: Mary Virginia Holekamp Rosa Lavendar Mollie Maresh, UGRA PE & I Committee, Chair RESOLUTION NO. 200]-09 RESOLUTION OF THE BOARD OF DIRECTORS UPPER GU.ADALUPE RIVER .AUTHORITY DECLARING NOVEMBER 26-30, 2001 FLOOD AWARENESS WEEK IN KERB COUNTY R'HEREAS, the Upper Guadalupe River Authority ("UGRA") is a conservation and reclamation district created pursuant to Article XVI, Section 59, of the Texas Constitution by the Texas Legislature as a "River Authority" through the enactment of its enabling legislation, formerly codified as Article 8280-124, Texas Revised Civil Statutes Annotated (as amended); and WHEREAS, UGRA's powers, duties and authority include, inter alia, among other responsibilities to prevent or aid in the prevention of damage to person or property from the water of the Guadalupe River and its tributazies; WHEREAS, UGR.A in 1987 promoted the development of a real time electronic rainfall and stream monitoring system to aid in flood damage protections for the residents and guests of Kerr County; and WHEREAS, UGRA transferred title of the rainfall and stream monitoring system to the Guadalupe Blanco River Authority in 1999 to allow the UGRA system to become a part of an upper segment of the Guadalupe River Basin monitoring system; and WHEREAS, UGRA believes that education and information regazding the dangers of the Guadalupe River during a flooding event will assist its constituents to better understand and to better prepare themselves, their neighbors and visitors to survive and protect their property during flooding events; and WHEREAS. UGRA believes the dedication of a week each yeaz to focus on the perils of flooding events will increase the knowledge and awazeness of the residents and visitors in Kerr County; and WHEREAS, the involvement of public information sources such as schools, civic organizations, religious groups and other associations is a more effective venue for the awazeness program: NOW THEREFORE BE IT RESOLVED by the Boazd of Directors of the Upper Guadalupe River Authority at a duly posted and noticed meeting held on August 15, 2001 at the Guadalupe Basin Natural Resources Center in Kerrville, Texas as follows: 1. That November 26-3Q 2001 be declared as Flood Awazeness Week in Kerr County. 2. That the General Manager and staff shall solicit and support all interested parties to promote Flood Awareness Week in Kerr County and by supplying information available to the staff to the vazious groups. WHEREAS, in 1989 the former Texas Water Commission declazed Kerr County to be part of Hill County Critical Groundwater Area indicating that existing groundwater supplies were incapable of meeting the projected demands for water supplies over the succeeding twenty (20) yeaz period, thereby necessitating the development of additional surface water resources; and WHEREAS, UGRA has been actively involved in and desires to expand the practice of conjunctively managing the available surface and groundwater resowces in Kerr County, Texas to asswe the long term ability to meet the municipal water supply demands of the citizens of Kert County; and WHEREAS, UGRA has reviewed and evaluated the San Mazcos River Foundation's proposal to obtain a permit for approximately 1.3 million acre-feet per annum of the flows from the Guadalupe and San Marcos River basins for non-consumptive in-stream uses and the negative impact such an appropriation would have on the futwe availability of water within said river basins for municipal and other higher priority beneficial uses; and WHEREAS, the UGRA Boazd has concluded that the San Marcos River Foundation's application is inconsistent with the highest and best use of the waters available within the Guadalupe River Basin, and is inconsistent with Senate Bill 1 regional planning process; and WHEREAS, UGRA Board has further concluded that the requested permit is in duect conflict with UGRA's efforts to develop additional swface water supplies for Kerr County residents from the Guadalupe River; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Upper Guadalupe River Authority at a duly posted and noticed meeting held on August 15, 2001, at the UGRA's Headquarters in Kerrville, Texas as follows: 1. The UGRA Boazd opposes the application of the San Marcos River Foundation (TNRCC Application No. 5724) to obtain a permit to appropriate water from the Guadalupe and San Mazcos River Basins for non-consumptive in-stream uses as described in the notice published in the Kerrville Daily Times on July 20, 2001. 2. The UGRA Board directs the General Manager to file a letter with the Texas Natwal Resowce Conservation Commission expressing UGRA's position in opposition to the San Marcos River Foundation's application and requesting a contested case hearing be granted on the same. 3. The UGRA Boazd further directs the General Manager to seek "party status" on behalf of UGRA in any proceedings conducted on the San Marcos River Foundation's Application No. 5724, and to consult with and retain such experts, including UGRA's legal counsel, as necessary to carry out the wishes of the Boazd expressed in this Resolution. -2- 4. The UGRA Boazd further directs the General Manager to coordinate with other entities opposed to the San Mazcos River Foundation's Application No. 5724. The UGRA Boazd further directs the General Manager to keep the Boazd apprised of developments in the San Marcos River Foundation's Application No. 5724, and to report to the Boazd on the status of the application at ]east monthly at the regulaz monthly Boazd meeting.
